Technically if you get stopped for trying to steal from a shop, the allegation of theft stops there.
Theft is to permanently deprive someone of goods, the store gets it back.
Also you could say that you were borrowing it with the sole intention of giving it back....no offence has occurred then as once again you are not depriving them of the items.
