Maddie: the doubts

The review of the “Madeleine McCann case”, already in progress, is forcing the joint teams of PJ and Metropolitan British Police (Scotland Yard) to an exhaustive verification of clues, including those who served to support the initial suspects against the McCann.
The case was shelved by the Public Ministry (MP), but in the process remains the evaluation of evidence and “scientific proofs” that PJ used to support that the British couple had some involvement in the disappearance of their daughter. The re-evaluation will imply, in any scenery, a judgment about the investigation and the way how, for example, the “biological traces” were used in the context which implicates the McCanns (thesis that the MP rejected). An important part, even crucial, to understand what happened in that fateful day will have to be found at the crossing of several statements (friends of the McCanns, bar employees and from the hotel). That is another important challenge for the double team, specially if there is no reconstruction of the crime. When the friends of the British couple started to be heard, the investigators noticed that inconsistent statements not allowed, the practice of building a thorough map of each of their movements, to understand in which space the child was taken. The PJ showed no trust in the statement of Jane Tanner, one of the friends of the couple McCann, who belonged to the close group that spent holidays at the village of Luz, in May 2007, and sat at the dinner table at the Tapas Bar. Tanner, 43 years old, was the first to talk about the figure of “ abductor”. She told to the investigators that she saw someone carry a child, coming from the Ocean Club (OC), where the British were installed. The visual statement was considered, at first, inaccurate, then, inconsistent. And it is not exaggerated to conclude that investigators welcomed this report with suspicion. Besides that, Tanner will tell police that the same man followed with child in his arms, in the direction of “Casa Liliana”, precisely where Robert Murat lives with his mother. The indication was highly disturbed for Murat, which ended being involved in the case, suspect of the abduction of the child, although later cleared. Was there some sort of intention to compromise Murat? This doubt may had “discredited” Tanner´s statement before the investigators, but these also didn´t find satisfactory answer for the time gap between the child's disappearance and the sighting of the alleged kidnapper. Tanner assured that saw him on the side, but, still, describes it with astonishing detail. Speaks of an dark individual, appearing 35 to 40 years, thin, about 1.70 m tall, very dark hair, beige linen trousers, black classic shoes and a peculiar way of walk, a very detailed description for someone who sees him by side in an low illuminated zone.

Gallery of suspects

The Tanner´s version even served for the investigators hired by the McCanns to create a portrait. However, the image ended discredited in several occasions. Computer experts decomposed, concluded that indicated familiar faces with the case, and a pig creator from Algarve listened by PJ, because it had resemblances with the face in the portrait. Other aspect still to be explained is to know how it was possible that Tanner crossed with the alleged kidnapper and, at the same time, Gerry McCann and a friend, which also saw Tanner, didn´t saw him, once they were in the same street where the kidnapper followed the trajectory. Gerry told police that he saw no one, his friend confirmed. Tanner observed other thing. So, there is here an undeniable contradiction the double team should now re-evaluate with the purpose of understanding what material value to give to the statement. Although the inconsistencies of the statement, specially if compared with others, don´t make Tanner suspect of anything, being considered kind and honest the information she presented, the truth is that her statement was not checked, even because it was not possible to verify it in real time, with others, because no reconstruction was carried by PJ. This will be one of the main challenges presented to the double team about the re-evaluation of the case, or, to understand with accuracy, where was all the people which accompanied the McCanns, as well others in the same ray around the apartment where the little girl slept.

Classify the crime

This is not about find a guilty person within the close circle of the friends of the McCanns, but it is vital to understand that the window of opportunity used by the person who took the child. However, first, is still necessary to conclude in what criminal way will be given to the disappearance: Maddie was abducted by a paedophile? Was victim of revenge against parents? Was a ordered crime? Accident? Kidnapped by sexual maniac? The MP rejected the PJ investigation thesis, that suggested that the accident followed by concealment of abduction, endorsing responsibilities for the McCanns, the thesis that provoked such an uproar. However, no certainty about almost anything, starting with the “mobile” of the crime or “modus operandi” of the author and ending in the way which Maddie took, unknown until today. There are, however, intriguing clues. One of the most enigmatic followed by PJ investigators implicated contacts with French police, which provided to PJ, the “file Chemello”, with informations about a couple that French authorities admitted the possibility of being involved in the disappearance of Madeleine. In July 27th of 2007, two months after the disappearance of Maddie, the liaison magistrate, sent, via French embassy in Spain, informations about suspicions of a man and a woman (born in Porto subsequently naturalized Italian) condemned in France for crimes that makes them “eligible” of suspects in the investigation in Portugal. Danilo Chemello, 64 years, was questioned by police in the south of Spain, in July 28th, in the sequence of an international warrant arrest. At the time, he and his wife Aurora, tried extort money from the couple McCann, claiming to have informations about the disappearance of their daughter. In the sequence of activities that related them with doctors, the French suspected that, for some reason, they might have crossed with the McCanns (also doctors), studying from that moment the criminal plan.

Strange alliance

The police of Marseille had received complaints about the treatment that Danilo and Aurora gave to the daughter with 15 years, compromising the health of the minor. Besides that, the suspicion of simulation of parenthood, to show children as daughters, when such children were not their daughters. The eldest daughter denounced the father to police telling that her half-sister Chiara, with 5 years, was forced to sleep and eat in the bathroom or at the garage, tied. Posteriorly, the authorities concluded that everything was organized to hide the existence of the girl, no school for her, not even to the doctor. But there was more. In the sequence of house searches into a couple´s residence, the investigators found reference about the alleged “purchase” of a child in Russia upon payment of 40.000 dollars. Data obtained from the couple´s computer, according police, revealed that between 2000 and 2001 had negotiated with an interloper from USA, the purchase of frozen embryos, to be sent for a greek doctor. The project included also hire a “rented mother”, but, for some reason, the Chemello abandoned that idea, However, even more intriguing was the reference about the existence of two sons that nobody knows where they were. Besides, the own biological maternity of Chiara offered doubts to the French investigators. Chemello declared to police that he was the biological father, but the record of birth has a determined date and the file of the doctor a posterior date. Besides, according informations sent to PJ, there was, surrounding the birthof this child, a succession of bizarre events: the eldest daughter of Aurora confessed that her mother not allowed to visit her at the maternity where she says she gave birth and never saw her pregnant; the assistance doctor talks about a parturient with different age of Aurora. There is also another detail to be add in form of doubt: for what motive the Italian would have bought three cribs (it is know that she wanted to adopt twins and announce it at the internet, receiving photos through email)? About the possible involvement with the disappearance of Maddie, besides the familiar curriculum of the couple might suggest, indeed, nothing concrete has been proved, but the clue can now be re-evaluated.

The pedophile clue

Was Madeleine taken by a pedophile gang or sexual freak of occasion? It is a possibility like many others. For a very long time, sometimes using robot-portraits, sometimes offering clues about pedophiles, with international connection, information appeared from several sources, almost from the press, specially British, which published the letter attributed to Raymond Hewlett, the British pedophile (died in April 2011, victim of cancer) which had been pointed as being involved in the kidnap of Maddie, where he assured knowledge that the child were signed and subtracted to a international “gang” that dedicates to the kidnap of children, by order, for rich couples that could not have offsprings, don´t want or cannot adopt. In this case, the clue had no pedophile purpose, but according the letter, huge amount of money involved paid by couples that wanted to “buy” a son. Their thesis were never confirmed and in the case of Madeleine, probably the most childish face worldwide spreaded, hardly can conceive that someone wanted to take the risk of kidnapping a child just to show her as “daughter”. In the book launched about the case, Kate McCann shows convinced that the alleged kidnaper watched the movements of the family until finds the right moment to attack. Kate considers unlikely that the abductor had an impulsive crime and admits that have been a planned action with method and careful, starting by the access to the reserve book of restaurant where the couple dined with friends. Kate tells that in the time of reservation was expressly requested a table closer of the apartment, with the purpose of having better access to check the children. “By definition, the book is accessible to the staff and, having intention, probably to the guests and visitors also. For my horror, without doubt, innocently, the receptionist wrote near the reserve which we intended to dinner close our apartments once we left our children alone and there was the need of checking if everything was alright”, tells Kate McCann in the book.

The traces and scent of dogs

This is, certainly, the most sensible issue in the process and also requires an absolute conclusive answer. What worth the traces of blood found in the rented car? What value to give to the scent of dogs of British police? At August 6th, the police siege increased around the couple McCann. The authorities concentrated in the rented car. Madeleine was disappeared for more than 3 weeks when the car was rented. Meanwhile, the dogs brought by British police (Eddie and Keela) had identified scent of corpse and other traces in the apartment and in the rented car.
PJ investigators gave credit to this information and in the process there is lot of information about dogs behaviour. Kate McCann makes other reading. She doubts. In the book “Madeleine” mentions with detail the performance of the dogs in the apartment. She tells that a video was showed, by PJ, in which the dogs ran through the house and posteriorly in the rented car, guided by a handler. The dogs gave specific signs, allegedly when detected something. Kate doubts. She told that false alerts can be attributed to bigger or smaller conscience of signs transmitted by the handler, and tells that this, in the report written, emphasizes the fact of these alerts not worth itself, without other material evidence.

A more “distant” investigation looking for answers

Formally, the process is closed, and only new facts can re-open it, but the Portuguese police authorities were receptive in analyze all informations gathered by British police (Scotland Yard) and Portuguese. From the national side, PJ appointed the investigator Helena Monteiro. One of the objectives, says to “Crime” a source related with investigations, is the reconstruction of all the steps given by the parents and friends in the night of May 3rd 2007.
PJ always defended the reconstruction of the facts, postponed for lack of cooperation of several relevant witnesses. The couple, which was considered arguido by Portuguese authorities in 2007, requested to the British Prime-Minister David Cameron, that all information gathered by police of both countries, analyzed. In July of 2008, The MP ordered the shelving of the process due to lack of evidences. The British, on their side, never closed the case, and recently, Scotland Yard agents were in Barcelona and in Portugal to “joint loose ends”. In the process there are many facts still without answer in the general context of the investigation. Especially, many of the evidences collected by PJ and confirmed by British labs, among those about the existence of blood in the rented car rented 25 days after the disappearance of Madeleine (Kate McCann suggested in the book that it was planted to compromise the couple). There are also traces of blood in the curtains and in the wall of the bedroom and odors of corpse in the rented car. To be explained remains still the contradictions about the hour of the disappearance. Evidences which, analyzed in a pondered way and with distance, might help to explain the disappearance”, an investigator related with the case told to “The Crime”. After having been in the departments of the PJ in Portimao and Lisbon, the process now moves to the Judiciary of the Oporto to enable "a more distant to about the case, so it says the assistant national director of PJ, Pedro do Carmo. The child is no longer seen since 3 May 2007, nine days before completing four years.

Court orders return of the books

The Court of Lisbon notified this Tuesday to the lawyer of the McCanns, Isabel Duarte, to return the books arrested to gonçalo amaral, confirming this way a decision already taken by the Relation Court of Lisbon, following an injunction filed by the English couple. The Relation decided, in November of 2011, that the opinions of amaral in his work didn´t violate the private rights of the couple McCann. However, they appealed to the Supreme, talking nullities in the decision, but the STJ returned the case to the Relation Court of Lisbon. Recently, the former PJ, who led the investigation about the disappearance of Madeleine McCann, presented at the DIAP of Lisbon, a complaint for suspicion that the 7500 books of amaral, had been destroyed. This week, the lawyer of the publisher Guerra & Paz, declared that, the books are at a warehouse at the Matinha zone, in Lisbon, and that should be delivered as soon as a judicial decision appeared. The 1st section of Civil Court of Lisbon, notified now Isabel Duarte, faithful holder of the books, to at the time of 10 days, to deliver them to Guerra & Paz.

Where is my daughter?

Kate tells in her book the moment when arrived at the bedroom where Madeleine was sleeping, and couldn´t find her: “everything was in silence. Then I noticed that the bedroom door of the children´s room was open, not the same way we left it open. (…) When I entered didn´t turned on the light to avoid wake up the children. When I released that Madeleine wasn´t in the bed, I ran to our room to see if she was in our bed. That would explained the door open. When I saw the bed also empty, a first wave of panic hit me. I ran again to the children´s room, the curtains of the window trembled with the wind. The window was opened and shutters pulled up. I ran all the house in less than 15 seconds, before went out looking for Gerry and our friends. When I saw our table I started screaming: “Madeleine disappeared. Someone took her!”

Maddie is alive?

This is what the Americans calls: “the question of one million dollars”. The parents believes that yes, it is possible that Madeleine is abducted, supported in cases which can, in certain way, be compared, like Natascha Kampusch or Jaycee Dugard, that lived years in the list of the missing, but were alive, although subjected to an existence of sexual slavery. Dave Edgar, a former police officer hired by the couple McCann admitted the hypothesis very likely that the hiding-place being located in an area about 15 kilometers surrounding Praia da Luz, from where Maddie disappeared in 2007. Another case that makes stronger this belief of the McCanns is the case of a child kidnapped in 2003, at a restaurant in Los Angeles, rescued alive 2 years, in Phoenix, Arizona, almost 600 kilometers from the place of disappearance. Amber Nicklas, don´t know how to read, never attended school and lived with a gypsy family. Her name and birth date had been altered, although Amber had been identified from a photo of her original birth certificate, using photographic programs by police and via and analyses. The resemblance with Maddie continues in this abduction scenery, admitting that it might be this the mobile of the crime. Amber was abducted by members of gypsy ethnicity and that is one of the most used in the private investigation that the British couple sponsors. A “witness”, Portuguese, named by the detectives, assured to see Maddie, in pyjamas, apparently drugged, 300 kilometers of Praia da Luz, in the company of a gypsy couple. Despite the details provided, this clue has never led to anywhere. And such testimony never reached the official investigation. However, lots of investigations happened around this “industry” of Madeleine´s sightings. That is an aspect that didn´t help, because, to each new sighting, the public opinion of both countries demanded clarification, forcing the investigators to disperse efforts. Until today, none of those sightings revealed consistent although some of them were object of thorough investigation through local authorities.

Scotland Yard is making a “reappreciation” of the Maddie Process. The virtual reconstruction made by Portuguese scientists was disregarded. The English want to make another...

No one has reopened the process because there aren't new data regarding the child's whereabouts. Underway there is a re-evaluation of the process led by Scotland Yard, that has the cooperation of a unit from the Regional Section for Criminal Investigation and Prevention of the PJ of Oporto. It was recently divulged that 37 English police officers have been, for the past year, reading translations and reassessing Maddie's process, which was archived by the Portuguese Public Ministry in July 2008, 14 months after the girl's disappearance.

The English police, just in 2011, have already spent 2,2 million euros in investigations and re-evaluations. During that time period, they have been in Portugal on four different occasions and have established a partnership with the Judiciary Police. The latter, in its turn created a special team “with a more distanced look”, wrote Jornal de Notícias, quoting Pedro do Carmo, deputy director of the PJ. That is, another team that had nothing to do with the first investigations.

New PJ Team


The new PJ team assigned to cooperate with the English, is coordinated by Helena Monteiro, who has had a similar role in Carina case, the young woman who disappeared in Lamego and was later found at the bottom of a ravine in that same region. This is not the first time that Maddie Case changed hands. Months before its archival, the process was pulled from the PJ in Algarve and given to a team in Lisbon, at the time lead by Paulo Rebelo without bringing something new into the world or to the process.

Four years since the archival and five since the disappearance of the English girl, after the PJ of Portimão/Faro and Lisbon, now it's Oporto's PJ turn to do the re-evaluation. At a forthcoming reassessment, probably another PJ team from another region will have it's turn.

More Virtual Reconstructions

A reconstruction is one of the tools of criminal investigation more used by the police, world wide, in the path towards the discovery of the origin of a fact and of the truth. It is written in manuals. A presential re-enactment of what took place in the night that Maddie disappeared (May, 3 2007) was never done.
The McCanns and the friends who accompanied them at the dinner never had the temporal availability to participate. The Public Ministry ended up forgoing that step.


The only known virtual reconstruction was made by the professors Paulo Sargento (Criminal psychology) and by Pedro Gamito (IT department) of the Lusófona University, using as basis the statements of the McCanns and their friends. By means of a specific software the statements given to the PJ were evaluated and cross-checked. Thus, one can now understand better the possibilities of each one of them being at a certain place and time, as stated by them.

This work by the Portuguese scientists was ignored, but now the Scotland Yard divulged that they will also use a software program to reconstruct those events. In English, that might be more enlightening.

Facts

On the night of May 3, 2007, the McCann couple left their three children alone in the apartment (the twins of two years old, and Maddie with four years old)and they went out to have dinner with their friends at a restaurant of the tourist resort where they were staying. A few hours later after the disappearance of one of the couple's children (Madeleine), several media and press advisers were deployed to Aldeia da Luz, Algarve, announcing to the world the abduction of the girl.

What took place inside the apartment from where she disappeared was never established. It's a fact that no hairs nor traces pertaining to someone else outside the circle of family and friends was ever found. It's a fact that no one knows what has happened to Madeleine.

Interruption of the Investigation

Since the launch of his book Maddie - The Truth of the Lie, the former PJ coordinator, Gonçalo Amaral has said: “There was no failure of the investigation, there was an interruption of the investigation”. The man who led the first investigation into Madeleine's disappearance, was removed from the case five months later, he acknowledged some errors in the investigation (the lack of reconstruction, the absence of tests to the twins and also to the couple and Madeleine's clothes). Failure or interruption, in fact, what did take place was the archival.

So no traces of an outsider were ever found? What's that got to do with it? An Abductor would hardly be chucking his DNA all over the place, and probably went in there with that in mind. The first check for forensics was a disgrace, and seemed to involve more dog hairs and cigarette ash than anything else.
And four months later was far too late.

Sargento's 'reconstruction' is valueless propaganda, Sabot, and now I have checked something, I will be revealing why....
