Justice Provider is national mechanism against torture

The Justice Provider is starting this Monday the national mechanism for the prevention of torture in the Convention against Torture of the United Nations, according to a resolution of the Council of Ministers published in the Official Gazette.
The measure had already been approved by the Cabinet on 9th, having been published in the Official Gazette on Monday and take effect from the date of its publication.
This mechanism appears under the Optional Protocol to the Convention against Torture and other Cruel, Inhuman or Degrading (PFCAT), the United Nations adopted in 2002 to foster the goals of the Convention, adopted in 1984, which aims to protect of persons deprived of liberty.
"This protocol aims to establish a system of regular visits undertaken by independent international and national bodies, the places where people are deprived of their liberty in order to prevent torture and other cruel, inhuman or degrading treatment", reads on the resolution of the Council of Ministers.
In the resolution, the Government explains that the Justice Provider, under its statutes, "may act as independent national monitoring the implementation of international treaties and conventions on human rights" as well as carry out inspection visits to establishments prison.
"Given that the Statute gives the powers laid down in the relevant articles of the PFCAT and that the Justice Provider has expressed on several occasions willingness to assume such functions, justified the designation of this State body as the national preventive mechanism, under and for the purposes of that Protocol, "explains the Government.
At the time of approval by the Council of Ministers, the chief of staff of the Justice Provider told Lusa that, with the approval of this measure, the provider is obliged every year to make visits and inspections of all places where there are people arrested, among prisons and police stations, and to report it to the United Nations.
Mariana Sotto Maior added that, despite UN delegate, the Justice Provider visits and inspections of detention centers, the subcommittee that is created with the Convention may also come to Portugal and they must be allowed to enter at all locations where there are detained.
