Constitutional Court rejects appeal of the only suspect in the disappearance of Rui Pedro.

The Constitutional Court (TC) refused to admit the Afonso Dias feature on his conviction to three years in prison for the crime of abduction of the young Rui Pedro, in 1998, in Lousada, told to Lusa the lawyer Ricardo Sá Fernandes. Afonso Dias lawyer, Paulo Gomes, has already announced that the trucker will complain about the decision.

The lawyer for the parents of Rui Pedro added that the action brought by the defense of Afonso Dias "do not even come to be appreciated" by the Constitutional Court, which found "are not meeting the conditions" for the purpose.

This decision of the TC is subject to complaint to the TC Judges Conference, Ricardo Sá Fernandes also explained.

The lawyer acknowledged that, with this decision of the TC, the case comes at about the "end of line", with this decision "very important for the family of Rui Pedro."

In his words, this judicial outcome serves as a "consolation" to the family after so many years of insistence, proving that "it is worth never give up" the "exercise of rights" conferred upon him.

Ricardo Sá Fernandes stressed that the "fundamental struggle" of the parents of Rui Pedro "continue", because the goal is to know "what happened to the young" on the day he disappeared, after "being with Afonso Dias and a whore."

Afonso Dias lawyer had appealed to the Supreme Court that upheld a sentence of three years of actual prison for his client for kidnapping crime of the young Rui Pedro.

Paulo Gomes said at the time the Lusa agency that the feature he would introduce the Constitutional Court has suspensive effect, so that Afonso Dias continue to wait for completion of the process in freedom.

On appeal, Paulo Gomes asked the nullity of the judgment which condemned the kidnapping of Afonso Dias Rui Pedro. The decision of the Supreme Court was taken aa June 5, 2014, when the court upheld the judgment of the Court of Appeal of Porto, reducing, however, the penalty of effective imprisonment of six years and six months to three years in prison.

In the court of first instance in Lousada, Afonso Dias was acquitted because it was not proven the crime, but the family of Rui Pedro, child was 11 when she disappeared on March 4, 1998, appealed to the Appeal of Porto, which would convict the accused to three years and six months in jail.

Afonso Dias should be arrested early next year. Filomena Teixeira, the mother of Rui Pedro, was very upset after receiving the news yesterday.

What an utter shambles! It's all wrong, IMO. Either:

1. An innocent man has been framed, for a crime he did not commit, by those high in Portuguese society.

or

2. A piece of sh*t that abducted a child and passed the boy onto a paedophile ring has been let off with a ridiculously-short jail sentence, and there is STILL no proper information about what happened to Rui Pedro. There is still even an outside chance he is alive, though I'd rather not think about what has happened to him in the meantime.

I just cannot imagine what his poor mother is going through.

Rui Pedro Case: Afonso Dias released

Afonso Dias was released from Guimarães jail this Wednesday. After about two years in prison, he is released on parole.

Afonso Dias, who was first acquitted but later convicted by higher courts, continues to claim innocence, ensuring he never knew what happened on March 4, 1998, the day that Rui Pedro, an 11-year-old boy and his friend, disappeared.

Since joining the Guimarães jail in March 2015, Afonso Dias has made several requests for precarious departures, but two have been denied. Usually, these requests are accepted whenever the prisoner fulfills a third of the sentence and maintains a good behavior, but in the case of Afonso Dias, the fact of being temporarily released was considered as a social alarm booster.

He could only go out for a few days at the last Christmas season. According to information collected by the JN, took the time to be with the family and, despite the cold, take a sea bath. Some days ago, it also got another precarious exit.

Judged 14 years after the death of Rui Pedro, Afonso Dias was first acquitted by the Tribunal de Lousada, who understood that there was insufficient evidence to convict him. But the Public Ministry and the family of Rui Pedro appealed to the Port Relation.


Precisely 15 years after the disappearance, on March 4, 2013, the judges condemned Dias with an effective sentence of three years. They believed that he had taken him to Alcina Dias, a prostitute whose testimony was devalued in Lousada, for contradicting what had been investigated by the PJ in 1998.

Can anyone name a single missing child case in Portugal that hasn't been fouled up/covered up/turned into a shambles by the PJ and the legal system?

It simply cannot, IMO, be coincidence that it happens time after time.

It would appear that the same ring of people are involved in the judicial branches?
