Re: MORE DIRTY TRICKS FROM GONC
I wonder how ordinary people in Portugal will feel when they see the latest stunt from the tax-dodger?

Re: MORE DIRTY TRICKS FROM GONC
Probably not, Tony. The ordinary people in Portugal must be pretty disgusted with him and his taxes are for little people attitude.
He didn't have much support in Portugal to begin with; this ploy is not going to help his image any.
And I notice Morais simply doesn't bother posting about his stunts any more; I suspect she is out of the loop now.
She eventually posted that awful, gushing piece about Gonc being strikingly tall and wearing intellectual hats some days after everyone else.
He's probably being advised by Levy.
I found a book Gonc needs to read:

Re: MORE DIRTY TRICKS FROM GONC
Dianeh has raised a couple of interesting points with her posts here:
http://justice4mccannfam.5forum.biz/t3758-gonc-tries-dirty-tricks-with-marcos
including this possibility:
I think this may simply be intimidation. It is difficult to believe that Marcos and the other lawyer can be found guilty of libel for accusing Amaral of the crime for which he has been found guilty.
What Gonc has to gain from this escapes me - does he really want yet more of his dirty washing appearing in public?

Re: MORE DIRTY TRICKS FROM GONC
It's propaganda
Propaganda and disinformation has worked for Gonc before; Why shouldn't it work now?
At the very least he is trying to put Marcos on the back foot, so that Marcos will be worrying and spending his time on working on defending himself, rather than on prosecuting Amaral. Am I right in thinking that Amarals case is next month?
NON-JURY COURT
But it beats me how the Portuguese state can get involved in such an obvious ploy How was it arranged? ... and if it did go to Court, maybe the Judges could be arranged ?
A Non-Jury Court sounds really sinister.
IIRC, Leonor was convicted by two out of three judges. The third Judge refused to convict. NO EVIDENCE, yet two Judges against one could convict. ETA: There were 4 jurors as well, but presumably they were either influenced by the judges or by the dreadful disinformation put about beforehand. I wonder if their judgement of the guilt was equal in weight to that of the Judges?
Michael Cook. NO CONVICTING EVIDENCE, but plenty of evidence to prove that he DID NOT DO IT. He was convicted and spent a huge part of his life in a foreign prison; wrongly convicted.
The Judge simply accepted the PJ's made up evidence
And let's not forget the torture. Would Marcos suffer the same sort of torture?
I have to say it. This seems more than sloppy to me. It stinks. The system and certain individuals stink to high heaven
Only imo, of course.

Hopefully @JillyCL:) If there isn't interference of the lusophobic UK media (@rupertmurdoch, @TonyParsonsUK, etc) & Team #McCann propaganda
Why does that Gonc mouthpiece insist on accusing people of being 'Lusophobic' - not that there is such a thing to begin with, as 'Portuguese' is a nationality, not a race.
She and her crew are the ones who appear to hate the people of Portugal, as they think dirty cops and corruption are all Portugal deserves.

The question is
"What do they personally get out of the present 'system'"? Why would they behave as they do, unless they get something back?
What?

Re: MORE DIRTY TRICKS FROM GONC
OK - it is horribly complicated. To the extent that even the European Criminal Bar Association (to whom I spoke for an hour this morning) ended by saying "good luck !!" in a meaningful way.
There are two types of defamation in Portugal. Civil and Criminal. The first is brought by an individiual, in a civil court, expecting a civil remedy. Removal of offending material, apology, damages.
The second is brought by the state, as a reult of a complaint. The remedy is criminal - fine (as distinct from damages) imprisonment etc.
So the first would be McCann V Amaral et al.
The second would be State v Correria, but resulting from a complaint by, say, Amaral.
Once a complaint is made, it has to be followed through certain stages. I understand that this complaint was the one made a couple of years ago by Amaral. It has now come to the top of the pile. The AG and PP will look at it to see if there is a case to be heard. It will then be listed for hearing before a panel of judges.
Portugal has an independent judiciary, which seems to be firmly resistant to state interference.
If the case should proceed, then Correria will be aware that he has a number of defenses avaialble to him. The truth. Public interest. fair comment. But here is gets murky - public interest and the truth may fail where the defamation is regarded to be personal to the plaintiff - ie not in connection with his professional life or actions.
It would therefore be necessary to see more detail of the nature of the complaint that correria is facing. Is anyone in touch with him? It would be interesting to see.
Very unsatisfactory, really.

Re: MORE DIRTY TRICKS FROM GONC
This is the report Gonc is complaining about, sans:
http://database.statewatch.org/article.asp?aid=29207
Your explanation does clarify things a bit, thanks.
His complaint actually couldn't have picked a worse time to surface, which rather puts a different interpretation on events.
As soon as we have more information, it'll be posted, no worries

Sans, do you mean, by that, that it is possible to say things that are true but still defamatory?
That report related to his professional actions, though I am not sure where this takes us.
In my personal opinion, two things could be happening here.
1. Gonc has gone mad - or even madder - and this is a last-ditch attempt to delay the libel hearing, so he doesn't have to get into the Portuguese version of the dock with that conviction for perjury around his neck.
2. If this has been kicking about for a while, the Portuguese authorities are being rather Machiavellian, digging all this up again at the worst possible time for Gonc.
We are really waiting for more information, when hopefully the picture will become clearer.
I do seriously have to question Gonc's sanity, however. It was an act of madness to go on the record telling an outright lie about the McCanns, proved as such by the police files, to DN.

Re: MORE DIRTY TRICKS FROM GONC
ACED press release
In Portugal we study the criminalization of the complaint of torture
Two employees have aced the trial scheduled for February 6, 2012, in Faro, accused of defamation and injury to the honor of a police officer accused of torture a prisoner, who gave public voice to access, as usual, by it was his grand design.
The prosecutors and PJ are known in the prison for their failure to investigate cases of serious crimes, in general, and torture in particular. What is recognized by some attorneys involved in these investigations. In the case of dealing with the process mentioned above, the torture was not only recognized by court ruling as the police allegedly defamed was convicted of lying to the court and thereby obstructing justice. In the same court in Faro. As will have been successful, since no one has been identified as the author of the torture known.
The victim confirmed the accuracy of the court transcript of his statement that the ACED released. But, apparently, the truth may be offensive to the honor of the state agents involved in crimes that should pursue but that in practice, collaborate. For access to documents HERE

Good find, Pedro thanks.
Might have known:
injury to the honor of a police officer
To Hell with the law, to Hell with living in a 21st century European democracy and not a Fascist police state, to Hell with the right to a fair trial......
It's all about Amoral's non-existent 'honor' yet again.
That man disgusts me; why doesn't he try behaving honorably, then he might not feel 'injured' quite so often.

Re: MORE DIRTY TRICKS FROM GONC
Thanks, Pedro. Interesting. The problem appears to be that no one was convicted of the actual Torture. Although The PJ Disciplinary Committee seems to think they know that the Officers who were charged, were in fact responsible, as one of the Officers acquitted of Torture and now Retired is having his pension rights looked into. The other two Officers who were acquitted are still employed but are also under review.
Hopefully, The Disciplinary Committee has more power than The Courts.
