Etan Patz Disappearance Solved? A Confession 33 Years Later Does Not Automatically Solve The Case

A man is in police custody after confessing to strangling Etan Patz, a 6-year-old boy whose disappearance three decades earlier started the movement to put faces of missing children on milk cartons. Police, however, remain skeptical, because they need more than a confession.

Etan disappeared on May 25, 1979 while walking alone to his school bus stop for the first time. The stop was just blocks from his home.

Pedro Hernandez told New York police that after he killed Etan, he wrapped the boy’s body in a bag and put it in a box somewhere in Manhattan. But when he returned a few days later, the box was no longer there, according to what a source told the New York Times.

But just because someone confesses doesn’t mean it’s a slam-dunk piece of evidence in solving a case. Anybody can walk into a police station and confess to a murder. Investigators need solid proof to back up the words of the confessor.

That appears to be the case here.

Hernandez was taken into custody in Camden, New Jersey, on Wednesday, May 23. As of today, he has not been charged. Investigators have been interviewing Hernandez as well as his family members to see if he had given them any indication over the years that he had killed the missing boy.

One positive link that may help prove the case is that Hernandez once owned a bodega – a small grocery – in the Patz family’s Soho neighborhood. Etan told his mother when he left for the school bus stop that he intended to buy a soda from a nearby bodega with a dollar he had in his pocket.

It was the first time Etan had walked alone to the bus stop; he had insisted, so his mother, watching from a window above as her son walked to the stop, allowed him. Information about Etan’s plan to buy a soda was first reported by journalist and author Lisa Cohen, author of the book After Etan.

More details in the case are expected later today during a New York Police Department news conference.

In a special feature on missing children, the New York Post reported on October 23, 1999 that Ramos was the prime suspect in Etan's disappearance. Ramos was known to the Patz family and was the prime suspect all along, but in the early 1980s they were still unable to prosecute Ramos. Patz was declared legally dead in 2001. Ramos was declared responsible for Etan's death in 2004 in a New York civil case but remains unprosecuted. Ramos denied responsibility for Patz's death.[8]

I don't know, bonny. It would, if true, at least give his parents and family closure. The police would seem to be extremely unsure about Ramos; they did not prosecute him which would mean the evidence was weak, if in fact there was any, and no use to the State Prosecutor. We will have to wait on the police giving out details as and when they have fully investigated his 'confession'. LL

It is a fact that, when a crime, especially a murder, is committed, there are always 'confessions'. Often they are by sensation seekers, mentally ill people or those who wish for 5 minutes of fame. That is why one must wait and see what comes out of the police interrogation of this man. There are probably certain things that only the killer would know, such as whether the child had been sexually assaulted - such information is usually withheld from the media and the public so as to make sure that when the perpetrator is apprehended a cast iron case can be made. Etan Patz - Recent Developments


On May 24, 2012, New York City police officials said that a man in custody confessed to strangling Etan Patz, the 6-year-old boy who vanished in SoHo on his way to school in 1979, wrapping his body in a bag and placing it in a box, an official said.

The man, Pedro Hernandez, told investigators that he left the box at a location in Manhattan, but when he returned several days later the box was no longer there, the official said. Investigators recently took Mr. Hernandez to that building. A second official also said that Mr. Hernandez told the authorities he had strangled the boy and discarded his body.

Shortly after Etan’s disappearance, Mr. Hernandez, who in 1979 worked at a bodega near where the boy disappeared, moved to the Camden, N.J., area, an official said.

Investigators have focused on Mr. Hernandez as a suspect in the past, one official said, although it was not immediately clear when he became the object of their interest.

The development came weeks after what had appeared to be a break in the decades-old death when detectives homed in on a SoHo basement in search of human remains. That search ended in late April with the police declaring that “no obvious human remains” had been found.

Overview

In May 1979, Etan Patz was given something he desperately wanted: permission to walk to the school bus stop all by himself, two blocks from his SoHo home. On the Friday of Memorial Day weekend he enjoyed that new freedom for the first and only time.

He never came home. He has since been declared legally dead.

Charges have never been brought, although the police have long had a prime suspect in the case, Jose A. Ramos, a convicted child molester who lived on the Lower East Side and was an acquaintance of a woman who worked for the Patzes as a baby sitter. Mr. Ramos remains imprisoned for molesting a boy in Pennsylvania. He once admitted to investigators that he was with Etan on the day he vanished, but has denied kidnapping or killing him.

Etan’s disappearance came before the era of missing children’s faces on milk cartons and made-for-TV movies exploring a seeming epidemic of vanishing children. The search for the little blond boy spanned continents, and the uncertainty about his whereabouts wilted New York City like a suffocating summer heat wave. To honor the boy, President Ronald Reagan declared May 25 as National Missing Children’s Day.

In 2010, the new Manhattan district attorney, Cyrus R. Vance Jr., said he would reopen the Patz case and give it what his spokeswoman called “a fresh look.”

In April 2012, investigators from the Federal Bureau of Investigation began digging in the basement of a building in SoHo in a renewed search for evidence. The building, at 127 Prince Street near Wooster Street, is half a block from where Etan lived and along the route he was to have traveled when he disappeared.

The basement area that was searched had been used as a workshop by Othniel Miller, a carpenter and handyman from Etan’s building. Investigators worked on the theory that Mr. Miller had killed the boy and buried him there.

A cadaver-sniffing dog was brought to the basement and indicated that remains were present or had once been present. However, during the search, no “obvious human remains” were recovered, according to the New York Police Department’s chief spokesman. The investigators sent parts of a cinder block with what appeared to be a bloodstain to the F.B.I.’s laboratory in Quantico, Va., for testing, but the results were negative. It was unclear if that was the only material sent to the bureau’s lab.

Mr. Miller was questioned numerous times by investigators over the last year. His lawyer denied that his client had anything to do with Etan’s disappearance.

An F.B.I. Agent Starts From Scratch

The trail to the SoHo basement that was excavated in 2012 began more than five years previously, when the F.B.I. agent assigned to the Patz case, Michael Ferrandino, was promoted, and his cases were reassigned.

The Patz case, with little progress in years, was at risk of being closed. Instead, Agent Ferrandino gave the case to a relatively junior agent, Thomas MacDonald, with the instructions, “See what you can do with it.”

Over the next few years, Agent MacDonald re-examined the case from scratch, according to a law enforcement official.

He summarized the known facts into a 50-page document he called the Patzifesto, a play on “manifesto.” He reinterviewed old witnesses, as well as the multitude of investigators who had worked the case in the years since Etan vanished in 1979. He asked them for their gut instincts about what had happened to Etan. He also interviewed Etan’s parents, overcoming initial resistance from the boy’s mother, Julie Patz.

More recently, Agent MacDonald, along with investigators from the New York Police Department who all worked jointly with Manhattan prosecutors to examine Etan’s disappearance, looked beyond the prime suspect, Jose Ramos. One law enforcement official described them as “more open to other ideas” as to who was responsible for Etan’s death.

At some point, Agent MacDonald’s search for evidence led him to consider Othniel Miller, a neighborhood handyman. Mr. Miller was one of several people who Agent MacDonald believed “had something to answer to,” the official said. Mr. Miller, who worked from the basement of a building at the corner of Wooster and Prince Streets, knew Etan and had in fact given him a dollar the day before his disappearance, for helping him with some small task. And he had added a new concrete floor to his workspace shortly after Etan’s disappearance.

Agents repeatedly interviewed Mr. Miller, who is now 75 and has had several strokes. They also tracked down his ex-wife, Phyllis, who told agents that her former husband had raped a 10-year-old girl.

Agent MacDonald met some resistance from Etan’s family. Stanley K. Patz, Etan’s father, would meet with the new investigator, but Julie Patz had had enough of new investigators over the years. There were a number of meetings between Mr. Patz and Agent MacDonald before she would participate.

Mr. MacDonald was transferred to Maine in 2011 and handed over the case to another agent, Jed Salter.

New York (CNN) -- Pedro Hernandez, a former Manhattan stock clerk who once lived in the same neighborhood as Etan Patz, was arrested Thursday in connection with his death, more than three decades after the 6-year-old went missing.
A then-19-year-old Hernandez allegedly lured Patz to a store with the promise of a soda, choked him in the basement and then disposed of the body using a plastic bag, placing it in the trash about a block and a half away, Police Commissioner Ray Kelly told reporters.
"Detectives believe in the credibility of the statement," Kelly said, referring to the man's earlier confession. Authorities were alerted to the suspect by a tip.
Hernandez, who had been working in construction until an injury sidelined him, is expected to be charged with second-degree murder, Kelly said. The suspect is expected to make an initial appearance in court Friday, with the district attorney's office formally filing paperwork.
He has no prior criminal record and is the father of a teenage girl, Kelly said.
Etan's disappearance exactly 33 years ago on Friday helped spawn a national movement to raise awareness of missing children, which involved a then-novel approach of splashing an image of the child's face across thousands of milk cartons.
According to police, in the years following Etan's disappearance, Hernandez told a family member and others that he had "done a bad thing" and killed a child in New York. He voluntarily left New Jersey on Wednesday night with detectives to travel to Manhattan and the building, currently an optical business.
Kelly described the suspect as remorseful. "The detectives thought it was a feeling of relief on his part."
He told reporters that other employees of the store were interviewed after Etan disappeared, but not Hernandez. "I can't tell you why," said Kelly, indicating the case apparently was a crime of opportunity.
The commissioner said it is unlikely police will find Etan's remains.

In her book detailing the investigation, author Lisa Cohen describes the plan Etan had the day he went missing. Just prior to his disappearance, according to the book, Patz told his parents that he planned to stop at a store to buy a soda with a dollar that he'd earned by helping a neighborhood carpenter.
The carpenter, Othniel Miller, 75, had met Etan the day before and was recently the focus of media attention when investigators announced they were again questioning him.
"Mr. Miller is relieved by these developments, as he was not involved in any way with Etan Patz's disappearance," said Miller's attorney Michael C. Farkas. "At the same time, Mr. Miller is very pleased that those responsible for this heinous crime may be brought to justice, and the Patz family may finally have the closure they deserve."
But a separate law enforcement source said Thursday that Hernandez's claims were being treated with "a healthy dose of skepticism." Investigators have not uncovered any forensic evidence linking Hernandez to the case, Kelly added.
Hernandez's name "came up more than once while interviewing others recently," said a law enforcement source, who added that authorities had been familiar with him years ago.
Renewed attention over the Patz case sprung up last month when investigators scoured Miller's SoHo basement, where Etan had been seen a day before he went missing.
But their search produced no apparent clues.
The tipster contacted authorities months ago after news coverage of their renewed search. That contact, at least in part, prompted investigators to question Hernandez.
A spokeswoman for the Manhattan district attorney's office, which reopened the case in 2010, declined to comment on the recent development.
New York Mayor Michael Bloomberg added that there's "still a lot more investigating to do."
"To his credit, District Attorney Cy Vance reopened (the investigation) in hopes not only of bringing justice, but also offering some closure to Etan's parents," the mayor told reporters Thursday. "And as a father, I just can not imagine what they've gone through."
Etan went missing on May 25, 1979, a block from his home in the Manhattan neighborhood of SoHo. It was the first time that he had walked to his school bus stop by himself.
His mother, Julie, learned after her son failed to return home that he hadn't been in classes that day. After calling the school and Etan's friends, she then called police.
The boy was officially declared dead in 2001 as part of a lawsuit filed by his family against a drifter, Jose Antonio Ramos, a convicted child molester acquainted with Etan's babysitter.
A judge found Ramos responsible for the boy's death and ordered him to pay the family $2 million -- money the Patz family has never received.
Though Ramos was considered a key focus of the investigation for years, he has never been charged in the case. He is serving a 20-year prison sentence in Pennsylvania for molesting another boy and is set to be released this year.
A source has previously said investigators wanted to expand the pool of possible suspects beyond Ramos.
Parents Stan and Julie Patz still live in their SoHo home and have not commented on the new developments. Police said Thursday that Stan Patz was a little surprised and overwhelmed by Thursday's developments.
Cohen, author of "After Etan: The Missing Child Case That Held America Captive," told CNN earlier that "the family's been living through this for 33 years. They've had many moments like this. They've learned how to deal with it."
Thursday evening, Cohen told CNN's "Piers Morgan Night" she had not heard of Hernandez before the arrest. The Patz family, she said, won't be making any quick judgments on this case.
Just weeks after Etan disappeared, an attacker abducted the first of more than 20 children to be kidnapped and killed in Atlanta. A suspect in that case was arrested two years later.
In 1984, Congress passed the Missing Children's Assistance Act, which led to the creation of the National Center for Missing & Exploited Children.
President Ronald Reagan named May 25, the day Etan went missing, as National Missing Children's Day.

I have just watched a segment on CNN's Connect The World, hosted by Becky Anderson, where she was interviewing a man who, I think, is a senior executive from the US Missing Children Squad. He was talking about today being the Missing Childrens' Day over there and he mentioned Madeleine, Ben Needham and 3 small children who vanished in Australia in the 1960s and haver never been found.

Jane Nartare Beaumont (aged 9), Arnna Kathleen Beaumont (aged 7), and Grant Ellis Beaumont (aged 4) were three siblings collectively known as The Beaumont Children who disappeared from Glenelg Beach near Adelaide, South Australia on Australia Day (26 January) 1966.
Their case resulted in one of the largest police investigations in Australian criminal history and remains Australia's most infamous cold case. The huge attention given to this case, its significance in Australian criminal history, and the fact that the mystery of their disappearance has never been explained, has led to the story being revisited by the press on a regular basis. It is also viewed by many social commentators as a significant event in the evolution of Australian society, with a large number of people changing the way they supervised their children on a daily basis.

Also mentioned was the man who vanished as a child, grew up and saw his age progressed picture on the net. He had been missing for over 20 years. LL

A New Jersey man has been charged with the murder of American schoolboy Etan Patz, who went missing 33 years ago.

Pedro Hernandez, 51, was arrested on Wednesday following a tip off to police about the disappearance in Manhattan in May, 1979.
It is the first arrest to be made in America's most notorious missing child case.
Investigators said Hernandez confessed to intercepting Etan, 6, on his way to a school bus stop, before luring the little boy to his Soho shop with the offer of a soft drink.
He then allegedly strangled him in the basement before throwing his body out with the rubbish.

1. The boy has NOT been found.

2. It is not certain yet that the confession is genuine.

3. If the confession is genuine, the dogs were wrong, as it appears to be a totally different basement which is involved.
