Repeating of part of the process of Casa Pia
Court agrees to hear three witnesses of the house of Elvas
The judges of the Casa Pia process agreed on Friday to hear three new witnesses in the repetition of part of the process on the house of Elvas, involving defendants Carlos Cruz, Carlos Silvino, Hugo Marcal and Gertrude Nunes.
However, most of the witnesses were rejected, meaning the court that the defendants did not substantiate the need concrete proof of production. As for the hearing of the victims, the court has not yet ruled.
The next hearing was scheduled for September 24, the day he accepted the witnesses will be heard.

Thank you, Pedro. I somehow don't think we are ever going to hear the truth about Casa Pia....isn't it odd how no police officers or senior legal people have been charged?

Moving to main forum for the enlightenment of ignoramuses like this hounder:

“Perhaps Amaral had tapped into some kind of national subconscious desire for this to all just go away. The country was already reeling from a child-abuse scandal involving Casa Pia, a state-run institution for orphans and other disadvantaged children (when this finally came to court in 2010, six men, including a TV presenter and a former UNESCO ambassador, would be convicted) ..' unquote Kate McCann.
Doesn't really go well with: “Police don't want a murder in Portugal and all the publicity about them not having paedophile laws here, so they're blaming us"?
So what were these six men accused of? Not paedophilia, since according to our source Kate there are no such laws in Portugal, they must be in prison for other crimes. Stealing toys? Or were the children unsupervised and so these men are in prison for child neglect?
Who don't seem to know anything at all about the Casa Pia scandal.

Re: update about Casa Pia
Wasn't one of the Convicted men provenly out of the country at the time he was accused of an incident of child abuse? And didn't The Judge say that it must have been another day?
Very worrying if this is true, which I'm pretty sure it is. Shades of, "Any Old Person will Do", which seems to prevail in Portugal. While the real perpetrators get off scott free.

Re: update about Casa Pia
As I recall, that was Carlos Cruz - he was, provably, in Brazil at the time of the alleged offence?
I am stunned, all over again, about the inexusable, pig-ignorance of the haters - they seem to swallow down any old junk, as long as they imagine it hurts the McCanns.
How they think their belief in lies helps their own cause, I do not know.
They know nothing about the twists and turns of Casa Pia, they know nothing about the shambles of the Rui Pedro investigation.
I doubt if they even know that the accused in Rui Pedro was freed by a JUDGE for the flimsiest reason imaginable.
Or that the PJ inspector who botched the case was disciplined by the force, not least because he tried to smear the child's family.
But, this is what they defend. They seem to neither know nor care that the PJ is trying to get rid of the rotten apples and clean up.
They are comforted by their own deliberate ignorance and bigotry.

Amazing really. We are all relatively well informed on all of these subjects and cases, having read whatever details we can get hold of, which didn't actually take that long, while they remain completely ignorant of anything but Lies and Distortions.
We know that a large number of them Read Here, so they have seen the information that is available to us. So why do they ignore it?

Re: update about Casa Pia
They also seem to be unaware of the fact that it has taken more than twenty years to get The Casa Pia Case to Court, and still not done, mainly due to trying to cover it up.
And it took more than ten years to get The Rui Pedro Case to Court because it had to be the fault of the parents, which they were unable to prove. Not surprisingly.

Casa Pia case
Carlos Silvino feature the TC is pending in the Supreme
by Lusa, published by Leonor Matthew Ferreira Today
Former Casa Pia driver Carlos Silvino appealed to the Constitutional Court's decision of the Supreme Court, which validated the penalty of 15 years in prison, but is still pending due to the reasons.
However, a source close to the process said Lusa that the appeal in the Supreme Court by the new public defender of "Bibi" has not risen to the Constitution because the Supreme sought clarification on the application.
Only after the clarification, STJ decide if the resource is able to climb to the TC.
The notification from the Supreme Court to support the resource already headed lawyer Pedro Dias Pereira, but this, contacted by Lusa said he did not want to testify on the question or other matters related to their constituent.
At this point, only an appeal to the Constitutional prevent the conviction of Carlos Silvino become final and that the former driver for Casa Pia go to jail.
In July, the Supreme Court upheld the conviction and 15 years in prison Carlos Silvino. Prior to June 29, the process Casa Pia returned partially to trial in the first instance, after the Court of Appeal of Lisbon having sent repeated the presentation of evidence on alleged sex crimes against former students casapianos, a villa in Elvas where the defendant resides Gertrudes Nunes.
A partial repetition of the trial has a trial session scheduled for Monday, with hearing four witnesses.
By declaring the nullity of the judgment in relation to events in Elvas (some dating from 1996, 1997 and 1998), the relationship ultimately benefited the defendants who were allegedly involved: the lawyer Hugo Marcal, Carlos Cruz and Carlos Silvino. Also included Gertrudes Nunes, who had been acquitted at first instance.
As for Carlos Silvino, the nullity of the judgment on the events in Elvas, meant that the ratio of Lisbon does not take into account three crimes alleged against him in this locality, and in reshaping the legal height as applying a single penalty of 15 years imprisonment.
The trial court had sentenced Carlos Silvino to 18 years in prison and even Carlos Ferreira Diniz and Cruz (7 years), Jorge Ritto (6 years and 8 months), Hugo Marcal (6 years and 2 months), Manuel Abrantes (5 years and 9 months) and acquitted Gertrudes Nunes. The defendants convicted were still obliged to pay compensation to victims.
The Casa Pia case went on trial on 25 November 2004.

Re: update about Casa Pia
Did Gertrude Nunes own the house at Elvas? I thought she had been cleared.
Is this also the house where one of the Defendants can't have been because he was out of the country on the date he was accused of being there?
This beginning to sound like a deliberate cock up to get certain people off.

Carlos Silvino held by PJ for serving a sentence in the Casa Pia
Former Casa Pia driver will meet the rest of the sentence of 15 years who was convicted of pedophilia in the process.
Former Casa Pia driver Carlos Silvino was arrested on Wednesday by the Judicial Police (PJ) to fulfill the remainder of his sentence of 15 years in prison that was condemned in the Casa Pia.
The arrest was made this morning in Lisbon and Silvino is now in prison attached to the headquarters of the Judicial Police, where probably still be transferred to another prison, knew PUBLIC next source of PJ. Carlos Silvino, also known as "Bibi" and the main accused in the case of pedophilia, has already served three years in prison as part of this process.
The former Casa Pia driver was sentenced to 18 years in prison in September 2010, the trial of first instance. The Court of Appeal of Lisbon came after reducing his sentence to 15 years, a decision which was upheld by the Supreme Court. Silvino also appealed to the Constitutional Court, which upheld the sentence imposed in a decision known last December.
Now that Silvino is already detained, after the exhaustion of judicial remedies which he brought, his lawyer, Peter Pereira Dias, may bring an extraordinary appeal on the basis of new facts - diligence that the law did not allow to "Bibi" in freedom.
These facts relate to the statements of former casapianos that recently came to belie all the charges they had made in court about being victims of pedophilia from the old driver, Carlos Cruz and the other convicted in the first trial of the case.
Part of these statements were made in the repetition of part of the trial concerning the facts of Elvas, a process that is still ongoing and that could worsen the pain of Bibi to a maximum of 20 years. The sentence of former driver will be deducted the three years already served in custody.
In 2010, the district court sentenced Carlos Silvino, who has been living in Moscavide by 128 crimes of sexual abuse of minor dependents, sexual abuse of person hospitalized, rape and child pornography. Prosecutor accuses Carlos Silvino of have "complex of homosexuality"

I despair of this Case. Years and years, and I'm not even sure that half of them are guilty.
How can they acquit the owner of the house while convicting people who supposedly used said house to commit offences, especially since one of them appears to have been somewhere else at the time?

Casa Pia trial
Lawyer of Carlos Cruz has been notified of the dismissal of the appeal
The lawyer of former presenter Carlos Cruz, Ricardo Sá Fernandes, was notified this Friday, the rejection of the appeal in the Constitutional Court, in the Casa Pia case. The judgment will become final on February 24, Carlos Cruz may be arrested from that day.
"I'll leave the judgment to transit," said Ricardo Sá Fernandes, adding that he had just been notified by the Constitutional Court (TC), where he had already gone this morning and could see where the judgment.
TVI has advanced, on Thursday, that Carlos Cruz will return to prison for the next few weeks, after the Constitutional had rejected the appeal of former presenter.
Speaking to Lusa, Ricardo Sá Fernandes recalled that on Thursday night, sent a fax to the Constitutional Court "as protesting this regrettable situation has been allowed an escape to a news channel, without which the defendants have been notified the decision. "
"The court should have clarified this yesterday [Thursday]," said the lawyer
However, this morning, the lawyer went to TC, where consulted judgment, and thus can confirm "that all questions of constitutionality raised were dismissed."
"The judgment is 323 pages, not yet read it, but it seems to me to be a part of the formal point of view, correct," he said.
Why not see in judgment "matter of concern no doubt," the lawyer will not proceed with any request for clarification or revocation of the decision. "From the standpoint of formal logic, it seems to me a piece unassailable.'s Point of view what are the criteria of justice is a part dececionante because it lives up to the formalism that we live in Portugal the law, which is a formalism that often prevents the courts, "he argued.
According to Ricardo Sá Fernandes, the judgment will become final on February 24, Carlos Cruz may be arrested at any time, from that day.
The lawyer pointed out that Carlos Cruz filed a complaint at the European Court of Human Rights and reiterated that now will "ask the acceleration of this process."
This is to Sá Fernandes, one of the "priorities right now." The other is to "ensure good conditions of detention for Carlos Cruz, accompany him the psychological point of view at this stage."
Moreover, the lawyer said he would "prepare a special appeal to the Supreme Court."
"The judgment itself says - one of the points raised was the possibility to add new documents, interviews given by people who recanted - and TC came to say that this matter can only be appreciated in the context of an extraordinary appeal in the Supreme Court" he recalled.
But Ricardo Sá Fernandes states that this "is not for now, because this kind of resource needs some preparation time," and "now this is not the priority."

Re: update about Casa Pia
Speaking to Lusa, Ricardo Sá Fernandes recalled that on Thursday night, sent a fax to the Constitutional Court "as protesting this regrettable situation has been allowed an escape to a news channel, without which the defendants have been notified the decision. "
