Donald Trump loses court battle against offshore wind farm
STV 11 February 2014 10:49 GMT
Donald Trump has lost his court battle against a wind farm being built off the coast of his Aberdeenshire golf course.
Planning permission for the 11 turbines to be built by Aberdeen Offshore Wind Farm Limited (AOWFL) in Aberdeen Bay was granted in March last year. It comes on the same day as the tycoon announced a new luxury golf resort in Ireland.
The energy minister Fergus Ewing decided not to hold a public inquiry into the wind farm application and granted the permission.
Mr Trump has vigorously opposed the plans from the beginning, claiming it will spoil the view from his luxury golf course at Menie Estate.
He went to the Court of Session for a judicial review into the decision not to hold a public inquiry and the granting of the permission and a hearing was held in November last year.
On Tuesday, Lord Doherty dismissed the petition, saying the Scottish Government had the power to grant the consent.
Trump’s lawyers had argued the government had been biased but the judge said he was not persuaded this was the case.
Following the decision, the Trump Organisation said they are reviewing the decision and were confident the wind farm would not go ahead.
In a statement, they said: "Today’s decision has not altered our unwavering commitment to protect our investment in Scotland. We are reviewing Lord Doherty’s decision and will pursue the legal options available to us as recommended by our Counsel.
"Communities world-wide continue to challenge the destructive proliferation of wind turbines and we will remain a fierce opponent at the forefront of this battle. Despite today’s decision, the EOWDC proposal has numerous economic and legal obstacles that will ultimately prevent its construction."
Shortly after the decision was announced, the Trump Organisation revealed the acquisition of a new golf resort in the Republic of Ireland.
The Doonbeg Golf Club in County Clare will be renamed "Trump International Golf Links, Ireland" and will offer golfers a 400-acre site on the shore of the Atlantic Ocean.
Mr Trump said: “I am thrilled to announce that we have purchased yet another incredible golf resort. From Trump National Doral, Miami to Trump International Golf Links, Scotland, known as 'the greatest golf course in the world,' we only have the best.
"Doonbeg is an already terrific property that we will make even better -- it will soon be an unparalleled resort destination with the highest standards of luxury."
The Irish resort, featuring 218 hotel suites, a spa and several restaurants, becomes the 16th property in Mr Trump's golf portfolio.
Doonbeg is going to lend itself to all sorts of Irish jokes...
