IMO, Gonc is in trouble. His groupies were keen enough to 'leak' that something was happening last week, but since then - silence.

If anything at all good for Gonc had been happening, they would have told the world by now.

Maybe the McCanns know what Amaral is going to do in court and admit it was libel and pay to the fund. That will then clear the way for Bennett to be sued as his leaflets were based on his book.

At a guess I would say that if there is any action at present, it is the lawyers having a chat, along the lines of "i'll show you mine if you show me yours".

Although anyone can go to law, there is a general duty to try to minimise the number of cases brought to court, whose time and resource is limited. Therefore they will try to reach an out of court settlement.

I would not be surprised to see a statement in a few weeks time saying that the parties have agreed an out of court settlemeent for an undisclosed sum and an agreement as regards costs. You can imagine the specualtion that would create!

True. In the meantime they seem to be think that "settling out of court" means that the McCann will have to make Amaral an offer of some sort.

Of course they will think that, Sans. But it is hardly likely since Amaral has undoubtedly Libelled The McCanns. Whether or not he is allowed to do this in Portugal is for The Court to decide, but The Court won't allow him to be paid for the dubious priviledge.

Portugal does have a remarkably odd legal system!

But under most legal systems if a plaintiff becomes convinced that they do not have a good enough case to win, they simply walk away.

It would then be down to the other party to countersue for costs etc.
