Picture it, I put the leaflet in an envelope, by accident. I sealed the envelope, by accident. I then put a stamp on it after I had addressed it, by accident. After I had accidentally asked you to pay by a cheque made out to my mother, and you accidentally sent me a £5 note which I accidentally forgot to send back and accidentally pocketed instead

I really cannot see the judge being very impressed with that; it sounds pretty intentional to me - and wanting the cheque to be made out to his mother makes things WORSE, not better.

Sym had the booklets and the leaflets so it must have been her. Probably not illegal on her part at the time since she hadn't signed an undertaking.
But the point is that Bennett was telling her how best to sell them and how to let him have to money. That was against the terms of the undertaking he signed.

I thought he might try and wriggle out of it by saying it was Sym, not him sending it out--but at the end of the day the stupid told the purchaser to send a cheque made out to his mother, sent to his address--he couldn't have made more of a perfect paper trail could he?

That appears to be his very elderly mother, Pedro - which does rather show that Bennett knew perfectly well he was doing wrong.

Bennett is supposed to be working for a living. That he apparently manages not to, and to finance several holidays a year, really ought to be telling them something.
As should the fact that he has TOO MUCH MONEY TO GET LEGAL AID.
On the other hand, do I actually care if these gullible fools hand over their cash - it might teach them a lesson when it finally dawns on them that they have been taken for a ride.

He may well go round looking like an elderly tramp, but he clearly has far more money squirrelled away somewhere than just about everyone else nowadays.
And - he should be in gainful employment at his age. That he doesn't have to work for a living really should be telling them something.
