Portuguese judge performs u-turn and allows Gerry #McCann to give evidence at libel trial of cop Goncalo Amaral

#McCann lawyers now expected to make new request for Kate to give evidence too. She has previously been denied.

#McCann libel case against ex-Portuguese cop Goncalo Amaral is due to resume in a fortnight but expected to be adjourned until September
So, Gonzo's got until Autumn to dream up another excuse to delay his trial?

I don't think it will come as a surprise to anyone that Bennett knows the ins and outs of getting documents from English courts to do with Madeleine's WoC status.
I have just remembered something, Bonny. Bennett wanted someone to challenge this WOC in the Family Court. On the old 3As he asked for someone who could foot the bill to bring the action. He further stated it would 'take a brave person' to do and after a few minutes posted again and asked "anyone?"
I seem to recall that it was something to do with having her declared dead? Maybe someone else remembers those details. Whatever it was, it was extremely unpleasant.
He's a piece of work.

Yes if the adjournment is granted. Now we know how their courts work, they will more than likely get it.

It wouldn't surprise me if Bennett was providing "expertise" to amaral regarding the ward of the court business. It would explain how amaral has managed to make a pigs ear out of it.

Re: Bizarre decision by judge in libel trial
Oh, of course!
http://stopthemyths.prophpbb.com/topic6637-50.html
And if he incorrectly told gonzo that Madeleine would be declared dead after seven years and that ward of the court status meant the McCann's could not sue on Madeleine behalf then I would not be shocked.
That is EXACTLY the sort of asinine, wrong 'advice' Bennett would give Gonzo, and as is being pointed out on Myths, would also explain why Gonzo has dragged the trial out for so long......

Re: Bizarre decision by judge in libel trial
Madeleine is never going to be declared dead by The McCanns. There is no purpose to this, legal or otherwise. In the absence of a body Madeleine will remain alive.
Someone had better tell Gonc.
On the question of The WoC. I would so have liked to see Bennett come up against Justice Hogg. She would have torn him a new one.

He does, Sabot but he also shows himself up as a coward who prefers to hide behind a woman's skirts.

Re: Bizarre decision by judge in libel trial
Portugal's worst detective has been burbling again:
Scotland Yard are useless and he, the Great Gonzo, is wonderful. An opinion shared only by his nasty, stupid fangirlz of both sexes, and inbetweens.
Whatever happened to Justice works in silence? Has he forgotten that, in his obvious panic?
PS - he looks like sh*t - and is that the Lucky Shirt he's still wearing?

He totally looks like sh*t in a dirty crumpled shirt. Appropriate because that is who he is.
He doesn't look even slightly content. In fact, is that fear I see in his eyes?

Lamplighter wrote:Under Portuguese law, a child is a minor until the age of 18 (minors are emancipated upon marriage - art.º 132.º Portuguese Civil Code). Under laws of most western countries, as Madeleine is a minor child, her parents are her natural guardians both in the law and ouside it. This only changes if the parents divorce and one gets sole custody. Even then, the sole custodian can be taken to court if the other parent has just cause, ie neglect or abuse. If the minor child is an heir/heiress then the parents would normally be executors of the child's estate. Therefore Kate and Gerry are the rightful guardians and the jusge is talking bollocks. As has been said, I would think this is a delaying tactic, probably not just to knobble the libel triali, but also to give certain people more time to cover their tracks. IMPO, of course. LL
Without seeing the judgement, and given that what we are seeing is a biased interpretation of the judgement, it is perfectly possible that the judge said that if Madeleine is a ward of the High Court, he would like to see the High Court join in the action.
Which would not be very good news for Team Amaral - Judges and Courts do tend to have great respect for each other. And to have the High Court comply would not be hard.
I have noticed also the comments about persons being decalted dead after 7 years, and agree with LL - I think the poor dears are under the impression that if a missing person is declared dead under the 7 year rule (to allow their affairs to be dealt with) that the actually ARE then dead.
Is Bennett tired of his freedom?

J-P, he has been making all kinds of ridiculous comments of late of which he knows next to nothing about. Some of those being rather libelous. However, Bennett always, in spite of himself, knew next to nothing about matters legal.
We could have a poll for the date of his incarceration.

Re: Bizarre decision by judge in libel trial
I wonder, has Gonzo ever considered earning an honest living, instead of milking Madeleine's disappearance for all its worth, despite the fact that he's the one who fouled the investigation up?
He's spend the last SEVEN years being the Great Expert, when he's actually achieved nothing except the adoration of a shower of braindead haters.
He's spent seven years abusing the McCanns and doing his best to meddle with efforts to find Madeleine - something he should have been doing seven years ago, instead of trying to frame her parents.
He's little more than a useless parasite. IMO, of course.

Oh my no, Bonny. Tut tut. That might mean his wages could be attached in the event of any lawsuit(s) against him that he lost. How could he possibly con his loyal fanz?

Re: Bizarre decision by judge in libel trial
Interesting, is it not, that Andy Redwood, in the middle of a grubby dig on wasteland, in the heat of a Portuguese summer, manages to look cleaner, tidier, and altogether more professional than the oafish Gonzo in a TV studio?
Or during the original investigation?
How would anyone feel if an unwashed oaf, already the subject of a criminal investigation, was charged with finding their missing child?
Portugal should be ashamed of putting perjurer Amaral and torturer de Almeida in charge of the case - they would both have been suspended in most countries.

Re: Bizarre decision by judge in libel trial
It is indeed almost unbelievable that these two were anywhere near any investigation, let alone that of a missing child.
It has become quite obvious to me that you had to approve of torture to get anywhere in The PJ.
God help anyone locked up in Portugal, any old shit evidence will do. It's a bloody disgrace.
