No they don't want the books back but it also shows how the believers think about it. Kathybelle, as a perfect example, seems to think it is all the McCanns fault, together with Ms Duarte, because they told her what to do.

She fails to understand that someone has to make a complaint, and since The Publishers don't want the books, and haven't even asked for them, then nothing is going to happen.

How much legal representation is £1300 really going to buy for Amaral at Court? He'll be using the services of a barrister I presume, so he might get 2 hours out of Tone and co's money?

I'll have to check, but I seem to recall reading that his lawyer, Cabrita, demanded €2,000 up front to defend Gonc last time...

Oh, that's right, Bonny. Wasn't that to pay for some court costs which are required ahead of it? I also thought that last time he didn't have to pay for his lawyer's fees as he was getting state aid?

Given Amaral’s previous stunning victory and the validation of both his theory and interpretation of the facts along with the endorsement of his right to author the book, I can’t see how he can lose to be honest.

I know that’s probably put the mockers on him (and I’m not a lawyer) but one would suspect he only has to turn up waving the verdict from the high court and it would be difficult for another court to find against a previous (and presumably higher ) court verdict.

No, what he has to do, is prove the child is dead and that the parents killed her.
This is a libel trial. If he cannot prove even one sentence in what he has written; then he is Gerflucked.

They are also ignoring the fact that it isn't just about the book, Tony. That on its own is bad enough, but his comedy-drama of a DVD is also involved, which is why TV companies have been named.

And then there are all his truly ghastly utterances in interviews; we should really have a thread just for those, for easy reference.

If the other parties have settled it will certainly influence the outcome of the trial.
Both of the above parties will have a fairly large legal team on a retainer fee; and if the lawyers have advised them to settle then Amaral doesn't stand a chance of winning.

Yes, odd that, isn't it? And notice the way they are avoiding the fact that that judgement was made on Yuman Rites grounds, which are always shaky....

IMO, the fact that Ms Duarte is still stuck with the books says it all.

I repeat, and it is quite simple. That Court decided that Amaral's book could not be banned until deemed Libellous in Law. Which has not happened yet.

To reiterate. You cannot deprive anyone of Free Speech until it is proven that a person has exceeded their Right to Free Speech by Libelling someone. Only a Court of Law can decide if Libel has occurred.

The Judge who lifted the ban did spout some rubbish about no harm being done, but it was never his place to decide, and nor was he asked to.

I never had a problem with the ban being lifted because it made sense to me. Free Speech is a Right, and has to be proven to have been abused.

But strange to say, no one was racing to put those books back on the shelves. Least of all The Publishers who had some fair old stake in this.

I wouldn't go quite that far, Lily, because Portuguese Law is still an unknown quantity, and some of The Judges are a teensy bit suspect. But the eyes of The World will be watching.

Good point, Sabot - his Yuman Rites decision was a most peculiar, hole-in-corner affair. This one won't be.

In spite of him winning that case on Yuman Rites grounds, where exactly did it get him? It's such a pity that his publisher, who owns all the books, was not interested in putting them back on sale, isn't it?
