GONC TRYING TO SETTLE WITH MCCANNS

Having been reading Havers forum, I am quite puzzled by all this talk about "the mcanns settling on Amarals terms".

Lets put it in simple terms.

If you sue someone for defamation, you are the plaintiff. The person who is being sued is the defendant.

If you subsquently decide not to proceed with the action (for example you think or are advised that you are unlikely to win, or just have a change of heart) , then you withdraw. The case ends. That is that. No further action, and the defendant is free to go about their business. There is nothing further required. No negotiation. Nothing.

If you are the defendant in a libel case, you will be taken to court. The plaintiff will proceed with the action, unless......

(a) the plaintiff decides for whatever reason not to proceed (as above)

(b) The defendant decides to try to make an offer to settle without going to court, in which case the plaintiff has the option of going through with the original action or accepting the offer to settle. (there are interesting inplication as regards costs surrounding an offer to settle - if a plaintiff refuses an offer to settle and the court actually awards a lower figure thyan that offered, the plaintiff may have to meet both parties costs - which may dwarf the aactual settlement figure)

(c) the plaintiff and defendant decide to try to negotiate a settlement, to save the court costs.

The rights are always with the plaintiff - call off action, accept an offer or negotiate - and there are no circumstances under which the case is settled under the "defendants terms".

Perfectly put, J-P. Now, we don't know what Gonc offered when he waved the white flag - indeed, we may never know. We do know who did the flag-waving though.

The libel action has NOT been dropped, however much the Gonc cult may like to delude themselves it has been.

We may also never know how little of his own money Gonc is willing to settle for getting back, but I have no doubt his lawyers will be wanting him to show some signs of paying their fees, which have been mounting horribly.

Once compensation has been paid to the McCanns, Gonc may get enough to get himself out of his self-created mess. Or not.

I don't think this is right at all,(see tweet below) if you bring a case against someone, then decide to not go through with it, you have cost the other person, who may be totally blamelss huge costs, and as I said before wasted their time, and hurt and stressed the family. Wouldn't lots of people just bring cases against people in order to cause them financial hardship and untold misery. No, it can't be right.............

Mind you, it is very revealing of the hounder mindset that they think 'lots of people' just bring cases to cause misery. They may do things like that - the rest of society has more respect for the law, as a rule.

ETA, the same basic principle applies in Portuguese law. Such ignorance!

Thank you, Maggs. So my guess of 300,000 Euros isn't far out as a settlement then. That will leave him 42,000 Euros plus small change, to pay his Lawyer and The Court at Faro.

I think it is starting to sink in, Tony, the idiots have stopped bouncing.

It's an indication of how deluded and reality-challenged they are that they briefly managed to persuade themselves that the McCanns woke up one morning and thought, I know, we can give the fat defective loadsamoney so he can carry on the vendetta he started on May 4th, 2007. Naturally, we are all in favor of him carrying on spouting libellous crap about fridges..


Instead of grasping the realistic scenario whereby Gonc has decided that having to STFU forever more is a small price to pay for retrieving some of his frozen assets.

Ironically, said assets having been safer frozen, than when he was spending money like a chav who had won the lottery.

With the criminal conviction for perjury on his record, and the Faro judgement that he had no honour to lose around his neck, Gonc simply could not have defended himself.

Not to mention his Ace being non-existent....and the PJ stripping him of his pension.

I personally suspect he has signed an agreement to hold his tongue already, especially after his disastrous appearance in the school gym.

I doubt very much that the McCanns or Gonçalo Amaral are not allowed to speak about the suspension as all court decisions are made public in the name of transparency of justice. Normally "segredo de justiça" (justice secrecy) only applies to police investigations. Please correct me if I am mistaken.

You have to admit that it has all been quite interestingly orchestrated. Smiffy announces the suspension of The Libel Trial with a use of words that could mean either/or. Morais pops out of the woodwork for the first time in months, tells a few fibs and twists a few more words. And The Nasties pile in shouting and hollering a load of bullshit.
Meanwhile they know that The McCanns aren't in a position to say anything even if they wanted to. And Gonc is hardly likely to admit that he has caved in.
So they are all having a lovely Hate Fest which can't be proven or otherwise at the moment.
But as ever, it will all come out eventually. At which point they will all pretend that it never happened.

It's a measure of how hysterical the pair of them are that textusa, of all people, is advising caution until a few boring things, like facts, are known.
