Absolutely astounding that supposed learned judges can use the word 'literary' to describe Gonzo's rubbish. Hulk Hogan got over a hundred million bucks from Gawker for less damage than the harm the disgraced ex-cop has done.

I know virtually nothing of their law, but surely the judge referred to by Isable Duarte should have recused himself as having a vested interest in the case. LL.... not surprised because one of the judges ruled in favour of a previous appeal overturning a ban on the book.

Did anyone catch this bit of that bizarre verdict?
On the other hand, we cannot see how the right of the subjects of this appeal [Kate and Gerry McCann] to benefit, following their constitution as arguidos, from the guarantees of the penal process – including the right to a fair investigation and the right to freedom and safety – may be offended by the contents of a book which, in its essence, describes and interprets facts that are part of an inquiry whose contents have been published.
But it wasn't a 'fair' investigation....for starters, the lead investigator had just been made an arguido over his conduct in another missing child case. Gonzo admitted himself that he woke up on the morning of the 4th and decided the McCanns DONE IT - though he's never actually explained what it is the McCanns DONE.
The McCanns were lied to about non-existent 'DNA evidence'. Gonzo made them arguidos without evidence, knowing full well that the law was going to change in a couple of days and he wouldn't be able to get away with stunts like that.

It's a badly-written, vicious, lie-filled potboiler, and is most certainly not 'literature'. It's a pity the UK media cannot find a way to expose it, and Gonzo, for what they truly are. We know it's crap, and nasty crap at that, but many don't, and imagine this is some great freedom of speech issue.
Portugal must be the only country in the Western world where dirty cops are allowed to tell outright lies about people, presenting them as statements of fact - even in the US, he'd be in trouble. Just look at Gawker and Hulk Hogan, and that wasn't nearly as bad as this.

The Former PJ inspector feels morally and financially harmed by the fact that his book about Maddie's disappearance was withdrawn from the market. The Lisbon Court of Appeals proved him right this Tuesday.
Gonçalo Amaral is going to counterattack after the Lisbon Court of Appeals ruled in his favour in the case against the McCanns. The judges considered that the former PJ Inspector does not have to pay 500,000 euro in damages and has the right to sell the book 'Maddie, The Truth of the Lie', as well as the documentary which was broadcast by TVI, thus overturning the decision of the Civil Court of Lisbon.
The Appeals Court believes that Gonçalo Amaral has exercised his right to opinion, and that he was not obliged to the duty of secrecy due to being retired.
In the book, the author argues that Maddie's parents were involved in the disappearance and concealment of the child's body, thus dismissing the abduction theory.

PS - it would be interesting to read more about these three judges, because it appears right now that they are all in the Portuguese Old Boys' Club. Bizarrely, one of them had even ruled against the McCann family previously. Only in Portugal!
There appears to be a clear difference between younger, more modern judges and the Old Boys. Not accusing, just pointing out - maybe the ECHR should be taking a closer look at Portugal, as it produces some bizarre 'verdicts' which are NOT in line with 21st century Europe.
