The Supreme Court is Portugal's highest court but has no criminal authority. Judges added their job was not to decide if the McCanns bore any criminal responsibility over Maddie's disappearance.
And they said it would be wrong to draw any inferences about the couple's guilt or innocence from their ruling.

Prominent members of the hate squad putting on a particularly revolting display this morning, dribbling on their keyboards with excitement because the Mail used the word 'death' in a McCann story.
Ever hear of sloppy reporting? Clickbait to get hits and reactions to keep advertisers happy? Fake News? No? All this seems to have passed them by in their eagerness to hurt Madeleine McCann and her family.

I don't think we could expect anything approaching reason from them?
As an aside, only yesterday I got fed up with counting how many errors' the Mail had made in only one story. Then I saw it was fairly consistent with other ones. I think they must be under pressure to get too many stories out?

The Mail can be appallingly sloppy, Lily, which is a great pity.
Its photojournalism is world class - but the captions! They tend to read as if they were written by a rather backward native of...I don't know, Ulan Bator?...who speaks English as a fifth language.
Still, I don't suppose the Mail proprietors greatly care, as its just about the world's biggest news site.

I can honestly say that I have never bought anything advertised by The Mail, or any other newspaper. But it is my choice of Site because it is good for getting what is going on.
You just have to decide for yourself if it is true or not.

The couple's fight-back was laid out in a nine-page complaint revealed today, which was lodged with the Supreme Court last Friday in a bid to invalidate its ruling rejecting the McCanns' libel appeal against Amaral and the makers of a TV documentary based on his book.
The document, drafted by the McCanns' Portuguese lawyer Isabel Duarte and and her colleague Ricardo Correia, says: 'The appellants understand the archiving of the case took place because during the inquiry, sufficient evidence had been collected to show the 'arguidos' had not committed any crime.'
They said the removal of the McCanns' 'arguido' status had legally-binding connotations and claimed the Supreme Court judges' argument it could be easily altered 'lacked foundation.'
Accusing them of acting 'frivolously' and contradicting themselves with their statements about the reasons for the 2008 probe archive, they added: 'It cannot be stated that it is not acceptable that the archiving of the case is considered the equivalent to proof of innocence.'
Mrs Duarte confirmed at the weekend the McCanns had lodged a formal complaint against the latest court ruling, although she declined to go into detail about why and how they were fighting it.

Just as Goncalo Amaral could have written a different book which would not have led to this juncture in the first place, the learned judges in their defence of his honour could have delivered their verdict in more measured tones leaving far less opportunity for their decision to be appealed.
At the root of it all is Madeleine McCann who some in the Portuguese establishment endeavour with every sinew of their being to have believed of as dead without a shred of anything to support their assertion.
From that insistence stems the real mystery.

All we know is that Madeleine McCann was removed from Apartment 5a, by person/s unknown, for reasons so far unknown. And that her parents were not involved, beyond making a catastrophically wrong decision.

In a decision signed on February 15, the judges understood that "the unlawfulness of the imprisonment is not verified" and decided "to dismiss, as unfounded, the writ of habeas corpus requested by the citizens of the Autonomous Region of Madeira ... in favor of Maria of Lurdes Lopes Rodrigues ".
The case goes back to 1996, when Maria de Lourdes felt wronged for not having been awarded a scholarship by the Ministry of Culture. After challenging the scholarship process, the investigator challenged the actions of the judges involved in the proceedings, in a way that was considered insulting.
On 29 September 2016, after a lengthy appeal and rejection of the psychiatric treatment measure proposed to suspend the sentence, the grantee was detained and taken to the Tires Prison to serve the three-year sentence of Imprisonment for crimes of defamation and libel against judges and magistrates.
Raquel Coelho, a member of the Portuguese Labor Party in the Legislative Assembly of Madeira and one of the applicants for habeas corpus , was not surprised by the court's decision on this specific request, despite disagreeing with the view of the judges on the legality of the case. "We consider that her arrest violates the Constitution," he said in statements to the public.
The regional deputy emphasizes that the request was filed as "the only option" to "try to humanize the Portuguese justice", considering the sentence of disproportionate arrest - it is one of the few people sentenced to serve an effective prison sentence for minor crimes - And that "it makes little sense for a person in these circumstances to be arrested for criticizing a judge."
Without confirming whether there will be scope for further legal action, Raquel Coelho guarantees that the petition's subscribers will continue to put public pressure to ensure that the case is not forgotten.

It's astounding, but seems to be accepted in 'democratic' Portugal. The jails in the US and UK would be overflowing if everyone who pointed out that the law is an ass, and so are some judges, was sent to prison.
Its a totalitarian Statist attitude, IMO. The judges are not public servants, they are agents of the State, so being rude about them is insulting the State. And probably insults their so-called 'honour', too.
