Goncalo Amaral Libel Trial - provisional date 13 SEPTEMBER 2012

I have today been served with new papers by Carter-Ruck in connection with the committal-to-prison trial on 9 and 10 May [start: 10.00am prompt, Wednesday 9 May].

Amongst the papers supplied is an on-the-record statement by Carter-Ruck Partner, Isabel Hudson, and I quote:

"While my firm is not instructed in the libel proceedings instigated in Portugal by the Claimants [Drs Gerald and Kate McCann] against Goncalo Amaral, I understand that...the case is proceeding to a full libel trial, and that a provisional date of 13 September 2012 has been given for the trial".

According to certain British newspapers, the McCanns launched their libel writ against Dr Amaral in early July 2009; thus if this provisional date sticks, it will take place more than 3 years and 2 months after the writ was first issued in Lisbon.

By the time the writ and application to injunct the book was issued [July 2009], Dr Amaral's book 'The Truth About A Lie' had already been published a year previously [July 2008], had sold over 200,000 copies, had been translated into several European languages, and had been made into a TV documentary viewed by a record 2.2 million viewers in Portugal...

...and had made a net profit for publishers and author of around 1 million euros.

So Gonc is in the dock for libel in September, is he? He'll probably be in jail by then, the way things are going.

Please note, Bennett is STILL claiming the McCanns want to 'commit him to prison'. How does he think telling falsehoods like that is helping his case?

Oh. I know. He's told Carter Ruck that he only repeated what Gonc said, and that's not Libel. Yet. So how can what he said be Libel.
Is Bennett planning on recanting when Gonc loses?

I actually don't care if he does or not, Sabot. I am looking forward to the whole hate campaign being shown up as the Big Lie it is over the next few months.

Gonc's going to lose; his Fridge Theory and all the rest of it has been totally discredited, not least thanks to Leveson.

Morais can change as many news stories as she likes; Team Gonc can plant as many fake 'PJ official sources' with Catholic news sites as they want.

The one thing none of them can do is change the truth.

And I am looking forward to finding out why Gonc appears to be in residence in a police station.

The McCanns came up with 3,000 or so pages of evidence against me. Mostly my own articles and postings.

I have responded by making a formal application to the High Court to be free...d from a part of one of the 11 undertakings I gave. That is the part that effectively prevents me from saying anything at all about the disappearance of Madeleine McCann - unless it is to support what the McCanns and their friends say about Madeleine being abducted.

In support of that application is an Affidavit about 65 pages long and with several exhibits.

My second Affidavit, i.e. my Affidavit of defence, is around 100 pages long and has further exhibits.

Obviously much of the contents of these two Affidavits and exhibits consists of factual matetial relevant to Madeleine's disappearance which is never discussed in Britain's mainstream media. At least on 9 and 10 May the content of my Affidavits and exhibits will be made public and those attending the court will hear what is in them.

Probably the central features of the case will be Isabel Hudson's cross-examination of me, and my cross-examination of her - plus I dare say a fair amount of legal argument.

I'm pretty sure the case of Spiller v Joseph in the Supreme Court will come into it (it's available in full on the net).

Most certainly the issue of whether this is a fair trial or not (under Article 6(1), European Convention on Human Rights) will come into it. It is certainly not a fair trial. The nation's most expensive libel lawyers are in the ring against a bloke who cannot afford to be legally represented, legal aid being refused to him on the simple and only ground that his savings are over £8,000.

The right to free speech under Article 8 ECHR will also come into it. It was the law under this Article that made the Portuguese Appeal Court (October 2010) and the Portuguese Supreme Court (March 2011) decide that the general public in Portugal should, after all, be allowed to read Dr Goncalo Amaral's book.

Yet in this land of free speech, I may be sent to prison, lose my savings and half my house for little more than circulating Dr Amaral's findings and commenting on them.

I do not expect justice on 9 and 10 May.

But I hope for it.

If there is any justice at all, he will be banged up for a year for every single innocent person he has targetted and harrassed, every single person he has posted foul lies and abuse about, every widow and child he has tried to make even more wretched.

And that is before we even start on what he has done to the McCanns and their family and friends.
