Re: 'Ex-cop earned hundreds of thousands from writing distortions and conspiracy theories'
36. The documentary was reproduced, and even subtitled in the English language, by third parties that published it on the internet, without permission and against the will of the defendant “V.C. – Valentim de Carvalho – Filmes, Audiovisuais, S.A.”?
Proved.
37. That illicit diffusion damages not only the rights that are held by defendant “V.C. – Valentim de Carvalho – Filmes, Audiovisuais, S.A.” over the documentary, but also its commercial exploration, because any citizen can watch the documentary, also only one “click” away?
Proved.
Shouldn't Hoho, Esse, and all the other prominent haters be apologising to Gonzo and co for depriving them of ill-gained income from exploiting a crime against a British child and her family?
Maybe they should have a whipround, and send the proceeds to those vultures in Lisbon?

Re: TAKING STOCK - Amaral, Butler et al
Postby scoobydoo » Thu Jan 22, 2015 3:16 pm
Amaral cannot sue the McCanns as they have spoken about him very little about him outside a court room and what they have said is either proven fact or pure opinion. He cannot sue them for sueing him.
I think the McCanns will win most of this case but will not receive such large damages. The judge ruled that amaral didn't harm the search so that decreases the award. So it will just be for the emotional damage, and may just be for them not the twins and very unlikely will Madeleine be awarded anything. If the judge is correct that he didn't hurt the search then at least that is something.
The most damaging part for amaral IMO is the fact the judge found he broke judicial secrecy. This means that he can't try to claim that his right to free speech overrides the emotional hurt to the McCann's as it is established he had no right to break judicial secrecy. So his one and only defence to the damage has gone. More importantly it could lead to prosecution which would also raise the possibility of prison. What's more if he is found to have broken the law during his suspended sentrance then it could have implications for that too.
The haters can't grasp that. Neither can they grasp that the McCanns PROVED their case yesterday. The only thing open to debate is the size of the damages.

Re: 'Ex-cop earned hundreds of thousands from writing distortions and conspiracy theories'
He did indeed breach judicial secrecy big time. A gap of three days before his libelous book hit the shelves is inexcusable.
Whatever he is ordered to pay will be too much where he is concerned and he will be so ordered.
If he faces criminal charges, and that is a possibility, then we will find out in due course.

Re: 'Ex-cop earned hundreds of thousands from writing distortions and conspiracy theories'
I never did think that The McCanns would get 1.2 Million Euros. But a sum in damages has to be asked for on filing the suit. It never was necessarily what they would get.
The WOC aside, can The McCanns expect damages on behalf of Madeleine? Debatable. Any money received would have to be put in trust, with a possible time limit.
But again, all monies asked for had to be attributable to each of them, for whatever reason.

Re: 'Ex-cop earned hundreds of thousands from writing distortions and conspiracy theories'
If it's a choice between believing a UK tabloid and anything emitted by Team Gonzo and its acolytes, I will believe the tabloid every time.
The tabloids occasionally tell the truth. Team Gonzo, with its 'sources in the investigation', its rabble-rousing hatebloggers, its mendacious 'court reporters', etc., NEVER does.
Just watch, a couple of months down the line, when the damages are awarded to the McCanns, there will be weeping and wailing from the Gonzo Cult, because they're too stupid to grasp that no sane person EVER believes their grubby idol and his hangers-on.
They're so stupid, they actually believe a disgraced ex-cop with a perjury conviction.

I´m no expert, but, I have always told that insane amaral broke the judicial secrecy.

There's no doubt now that he did indeed ignore the secrecy laws, Pedro. I hope that is taken further, and he and his chums are charged.
Because be in NO doubt, the printers, publishers, etc., all knew what he had done and turned a blind eye.
Best just leave the haters to their delusions, Sabot. They've had years of practise in believing sh*te, so they're not going to change overnight.

I have been waiting for many moons for this Secrecy thingy to come up. It just isn't possible for it to be ignored.
And didn't Isabel Duarte mention this some time ago in Court?

Lisbon court to outline facts proven in McCann defamation case
BY TPN/ LUSA, IN NEWS · 21-01-2015 11:03:00 · 0 COMMENTS
A Lisbon court is on Wednesday to reveal the facts seen as proved in a civil case in which the parents of Madeleine McCann, are suing the former police inspector who initially oversaw the investigation into the then three-year-old's disappearance from a holiday apartment in the Algarve in May 2007.
The judge, Emília Melo e Castro, is to announce what facts will be considered by her in reaching her verdict, which is to be announced later.
In the case, Kate and Gerry McCann and their three children are seeking €1.2 million in compensation from the former inspector, Gonçalo Amaral, for allegedly defaming them and violating their rights and freedoms in publishing a book about Madeleine's disappearance in which he concludes that she died in the apartment.
The family is also suing Amaral's publisher, the producer of a film based on the book, and the television company that broadcast it.
The case has dragged on for more than five years, with several postponements and an attempt to settle out of court that was not successful.
That's a straightforward enough report, Pedro.
Anything concocted by LEN PORT or Natasha Donne is utterly worthless, as they are both members of the hounders' hate site - she calls herself Harry_Lime there. Those two have put a good few blatant lies into internet circulation.

Sez Montclair, to someone who doubts the honesty of the pretendy 'court reporters'.
Why would you believe that the person who did the translation would add something that wasn't there?
Why wouldn't you, more like. That lot have been lying, twisting, spinning, censoring and outright inventing material to suit their unpleasant idol Gonzo virtually within hours of Madeleine's abduction.
Why they have been lying, and smearing her parents, for over seven years is another matter entirely.

Re: 'Ex-cop earned hundreds of thousands from writing distortions and conspiracy theories'
Sorry Darryl, that is exactly what the judge wrote in her document which she gave to the lawyers to read.
She gave it to the lawyers, did she? And it was written in English? - well, it must have been, to have 'i.e' in it. And why did 'the lawyers' then pass it onto reporters-for-Gonzo?

A few more months of hearty argument, and then they'll change the theme fractionally. This is a major pastime for some, although I worry about me sometimes.
As far as I can see at the moment, it's all in the delivery, if not actual mistranslation and leaving bits out. I expect we will all still be here in 2024. At least, I hope I will.
It just suddenly occurred to me a couple of days ago that all of the nuances are missing, so we never get any real idea of how things were said.

Re: 'Ex-cop earned hundreds of thousands from writing distortions and conspiracy theories'
I expect they were ironic nuances, Sabot, according to the Gonzo cult, Portuguese courts go in for irony a lot. Good rule of thumb - if a hater, hounder, forker, or Gonzo-worshipper has said it, it's a lie. It never fails.
