Also Ana has explained she was first seduced by Amaral's sweet smooth talking and she states, this is exactly what he does on the TV and radio etc, she thought he was a man who had been wronged by the

What a squalid affair that was! She must have been terrified for her family's safety to make all that public, and stop Gonc carrying out any of his threats.

My own personal opinion is that Portugal really has to clean this mess up; it's been rumbling on for years, and it is obvious to a blind man that Gonc and his cronies have been involved in mistreating people in custody.

There are just too many incidents, involving the same group of people over and over again.

And let us not forget that Tavares de Almedia, author of the forkers' beloved half-time report, was an arguido in the strange business of Virgolino Borges.

Three inspectors from the Polícia Judiciária go on trial the day after tomorrow, at the Court of Boa Hora, in Lisbon, over the crimes of torture and other cruel, degrading or inhuman treatment.

The Lawyers’ Order – similarly to the case of Leonor Cipriano – which takes place in the Court of Faro – has also constituted itself as an assistant in this process.

António Manuel Alves da Cunha, José Sanchez Diamantino dos Santos and Vítor Manuel Tavares de Almeida are the arguidos in this process, the facts having taken place in the year of 2000, according to the accusation.

At that moment in time, the victim, Virgolino Borges, accused five inspectors – it was only possible to discover the identity of three of them – of torturing him during an interrogation to make him confess to a robbery.

According to the accusation dispatch, the rail worker from Sintra was summoned to the Judiciária’s offices in Lisbon on the 2nd of March 2000, as a witness to a theft that had taken place in his work place, the CP [Portuguese railway company]. During the questioning and after having been made an arguido, Virgolino says that he “suffered a slap on his face”, was “handcuffed with his hands behind his back, forced to remain standing, and hit with a fist several times, namely in the stomach, kidneys and ribs area”.

Further according to the accusation, the arguidos ordered the victim to take off his shoes, and Virgolino suffered “several blows with a latten against his feet until it broke”. He was “also kicked when he fell on the floor”. According to the document, Virgolino “passed through and lived during that interrogation – which took place between 7 p.m. and 2 a.m. -, hours of terror”.

The victim was then led to the PJ’s prison “and his entry file registered that he presented signs of aggression”. He was observed by a nurse who mentioned in his report that the rail worker “refers to pain in his back and to his abdomen and chest, and presents some scratches and bruises, which according to the inmate were caused at the Polícia Judiciária through aggression”.

Virgolino was presented to a first interrogation on the 3rd of March, at around 7.15 p.m., and the diligence ended at 8 p.m. He remained in liberty under the obligation of stating his identity and residence. He didn’t tell the judge anything about the assault “because he feared reprisals”. He was assisted at Amadora-Sintra Hospital on the night of that same day.

Wouldn't that be a Civil Case? No. There is something else that someone isn't telling.

The complainant is listed as plaintiff - in this case Amaral. Basically, this comes under criminal code, and therefore is in the name of the state. But the state will not act unless there is a complaint.

Interestingly, there is no legal aid to bring a case of criminal libel.

I really would have thought Portugal was in enough trouble with Amnesty and UNHRC without the state giving every appearance of condoning torture.

I don't know what to make of any of it, sans, it is positively Kafka-esque.

The only thing I can think, is that Gonc started this a few years back, when he was riding high, buying new hats with the book money, writing for CdM, and inflicting the Fridge Theory on anyone who would listen.

It's a different picture now, though, with his involvement in the torture proven twice over, and assorted other Gonc scandals in the public area.

I really find it hard to believe that the Portuguese state would wish to be seen condoning torture - it would be an act of madness.

I do wonder if he has finally been given his court date - at the worst possible time for him, when all the old records of his past Bad Acts can be legitimately dug out again and brought to a new audience?

I think you are right, Bonny. This complaint was made more than three years ago when Gonc thought everything was going his way.
Marcos Correia did make the statement. Hopefully now it only has to be ruled as true, or not.

Personally, I find the whole concept of criminal defamation quite alien. And it is truly a hangover from the days when it was used to silence critics of the state, officials, politicians and members of the professions.

You may recall the case of the woman who lodged a complaint against a lawyer. He had continued with a property action after the parties had agreed settlement, and she complained to his professional body. The next thing she knew she was facing an action for criminal defamation.

The Portuguese do seem to be terribly sensitve souls. Pat Brown should watch out......

It is normal for me to check my stats daily and, I usually have a couple of hundred visitors to the blog over say, a week. So I was very surprised to find this morning, I have had over 300 visitors reading the blog over the last 12 hours. And a very good morning to them all.

These readers are from countries as far East as Russian and as far South as Brazil.
I followed some of the links which led to forums throughout the world and I can say, after using Bing translator, Marcos, you have a great deal of support. Keep up the good work and don't let Hinky get you down.

Fantastic, Tony. So pleased to hear that.

I despise thugs and Fascists; let's hope that Gonc has pushed it one step too far, finally, and the wider international community start taking an interest in this.

It's good that all the old material about Gonc's loutish behaviour is being spread to a whole, new audience.

And if this does go to court, that Marcos makes the most of the platform it will give him.

Lovely stuff. And since it took in excess of four years to get the case of the torture of Leonor Cipriano into Court, then I have no trouble in believing this.
