Either Portugal don't care, or don't know, how this case highlights torture by their Judiciary in an alleged civilized country. The reaction by the state, certainly gives the impression, the country of Portugal condones the actions of judiciary thugs

Who lied in the Maddie case? The answer lies in what is told by former inspector Gonçalo Amaral. All the fantastic and never proved theories that a certain press has spread are in his book. And they remain without any evidence to sustain them.
Gonçalo Amaral must be a man who is full of himself. He was responsible for a calamitous investigation in the 'Maddie case', but according to the balance that he does, everyone is to blame except for him.
According to Gonçalo, the blame lies with the fact that the McCanns' apartment was not preserved, with the British police that did not fully cooperate, with the journalists that stood in the way, with Her Majesty's government that pressured, with the Portuguese government that let itself be pressured, with the prosecutors, with the PJ's directors, with the conspiracy of the powerful and – if he is allowed to continue unloading – it will hit the CIA, the Masonry, Opus Dei, the Trilateral, Bildberg and the Pope, the usual suspects of the conspiracy theories that circulate on the internet.
The same inspector must not be inhibited (not to mention being ashamed), because after the suspicions that befall him due to the conduction of the 'Joana case' (another missing girl, whose mother, who was condemned over her death, accuses the PJ of torturing her) and the disaster of the 'Maddie case', he pretends to be a national hero and the holder of the truth, against everything and against everyone, and he maintains an absurd theory that does not resist a minimally structured analysis.
Amaral probably didn't think about the fact that it does not become him to talk and to write in detail about a process which – despite having been widely abused – is still under judicial secrecy, either. Or that it does not become him to be a judge in his own cause.
But the most interesting about the former inspector's book is that we get to know where the famous 'lies' from the media that everyone talked about, came from. Finally, we can verify that the most unbelievable theories came out of that illuminated brain. And that certain newspapers, lacking a better option, published them without contradicting, without investigating, without logics and without evidence.
But Gonçalo continues to state his 'conviction' that Maddie died in the apartment. He must have inherited from medieval justice, this notion of 'conviction' without evidence; or from Alice, by Carrol, the idea that first the criminal's head is cut off and then the trial is done; or from 'The Foreigner', by Camus, the fixation in the importance of the criminal's "facies" or the fact whether one does or does not cry in front of death.
The lawful state bases itself on evidence, beyond doubt. The notion that innocence prevails over guilt – when there is no evidence to the contrary – is what separates civilization from barbarism.
Unfortunately, there are remains of barbarism among us. Until very recently, it headed the PJ in Portimão. I hope he was the last one.

It's a bit of an impasse, I think? The torture is proven; that it was done by police officers is also proven, BUT Leonor Cipriano couldn't positively identify them due to having a bag over her head, so the three named in court walked free.
It just goes round and round in circles, and will continue to so until someone decides to 'fess up and tell the truth.
Amaral still has to face charges over the beating-up of Joana's stepfather, Leandro Silva - it is alleged that he hit the man while other police officers restrained Senhor Silva.
Who, before anyone starts shouting about 'child killers', has nothing to do with anything, he just had the misfortune to be rounded up with the other Usual Suspects.

I had some vague idea it was the same case started all the way back in 2008 but in the fashion of Portuguese justice only just being dealt with. Perhaps I am wrong.

OK - it is horribly complicated. To the extent that even the European Criminal Bar Association (to whom I spoke for an hour this morning) ended by saying "good luck !!" in a meaningful way.
There are two types of defamation in Portugal. Civil and Criminal. The first is brought by an individiual, in a civil court, expecting a civil remedy. Removal of offending material, apology, damages.
The second is brought by the state, as a reult of a complaint. The remedy is criminal - fine (as distinct from damages) imprisonment etc.
So the first would be McCann V Amaral et al.
The second would be State v Correria, but resulting from a complaint by, say, Amaral.
Once a complaint is made, it has to be followed through certain stages. I understand that this complaint was the one made a couple of years ago by Amaral. It has now come to the top of the pile. The AG and PP will look at it to see if there is a case to be heard. It will then be listed for hearing before a panel of judges.
Portugal has an independent judiciary, which seems to be firmly resistant to state interference.
If the case should proceed, then Correria will be aware that he has a number of defenses avaialble to him. The truth. Public interest. fair comment. But here is gets murky - public interest and the truth may fail where the defamation is regarded to be personal to the plaintiff - ie not in connection with his professional life or actions.
It would therefore be necessary to see more detail of the nature of the complaint that correria is facing. Is anyone in touch with him? It would be interesting to see.
Very unsatisfactory, really.

It is indeed the complaint Gonc filed ages ago; seems rather a big coincidence that it has finally surfaced.
All that being dragged up again, at the very same time as he is under scrutiny at the libel trial, is liable to be a PR disaster for him, I think?

The Court of Appeal in Évora considered all the evidence in the seat of the Court of first instance is amply sufficient to prove the existence of a serious crime of torture of Leonor Cipriano by police officers of the Portuguese State

It is bad enough this woman was beaten by cowards; but, to know those cowards represented an institute that is supposed to serve and protect its citizens, magnifies the disgusting actions of Amaral and his henchmen. They have shamed not only the force they served but their country too. May they rot in hell!

No, there isn't. Gonc lost his appeal and the judgement and sentence of the first court was upheld. Which is why he is currently serving an 18 month suspended sentence and if he as much as spits on the sidewalk he will be jailed.
Which could present him with a few problems as he still has to be tried for allegedly assaulting Leandro Silva.

Do they really think that Amnesty would be involved in this if all it was, was some Evil Team McCann plot to smear poor ickle wickle Gonc? Do they really think that this would have been taken all the way to the UNHRC if it was some kind of Evil Team McCann plot, etc?
This all started well before the McCanns had even heard of PDL; it has been brewing for years.
Has it never, ever occurred to them to wonder why Gonc has so little support in Portugal? His fellow officers boycotted his 'retiral' dinner - that should tell them something, surely.
Morais' Portuguese We Love Gonc petition has all of 1942 sigs - AFTER TWO YEARS. The population of Portimao alone is well over 40,000 - does that not tell them something?
Only FIVE people, including Morais, turned up to support Gonc at the last Lisbon hearings - does that not tell them something?
Do they actually think that the people of Portugal want their country to be dirtied by an ex-cop who is incompetent at best, and possibly something far worse? The tax-dodging, the drunkenness, the domestic violence, is all a matter of public record.
And the McCann family walked right into the middle of this mess.
Of course the British Ambassador was in PDL as soon as possible - do the forkers not realise he would know all about Gonc, and his disgusting conduct? That Gonc had just been made an arguido for his involvement in the torture of the mother of another missing child?
They simply do not seem to grasp the reality of this situation.

It is actually horrific. Goncalo Amaral is nothing but a thug. And he was a thug in uniform, which is far worse.
Paiva might have made a half decent PJ Officer if he hadn't fallen under the influence of that fascist pig. But I bet Paiva's career has gone for a burton now, after what he had to say in Court.
I would laugh, if it was funny.
